MINUTES OF THE JUNE MONTHLY MEETING

MINUTES OF THE JUNE MONTHLY MEETING OF ATHY TOWN COUNCIL HELD AT 7.30 P.M ON WEDNESDAY THE 18th JUNE 2008 IN THE MUNICIPAL OFFICES, RATHSTEWART, ATHY.

The meeting commenced at 6.30pm. The Cathaoirleach welcomed the Chamber of Commerce and the members present and noted this was a preliminary meeting and hoped to set out an area of mutual responsibility and proposed that the Council meet with the chamber three times a year.

Paul Cunningham, President of the Chamber thanked the Council for setting up this meeting. He elaborated on how the Chamber was established to represent the businesses of the Town. A copy of letter, which had been circulated to all members by the Chamber previously, was handed in and this was noted.

The President Paul Cunningham informed the meeting that the Chamber had been divided into six categories in the hope of making it more appealing and active. He noted that the Chamber needed to be brought up to speed on the current situation with the Roads network in the town. The Cathaoirleach pointed out that there had been delays on the SDR due to negotiations with CIE but was confident that good progress was currently being made. The Chamber highlighted the importance of ‘Broadband’ and a good ‘water supply’ in the town. The President highlighted the importance of having a good working relationship with the Council and it was agreed that any policies formulated by the Chamber would be forwarded to the Council. A briefing on the roads was suggested for the next FORUM meeting. The Cathaoirleach concluded the meeting by saying that he would like to see a strong and vibrant Chamber of Commerce in the town located in a nice building and hoped this was the beginning of a structured relationship.

At 7.20pm the Cathaoirleach welcomed Mr Tom Yates from Athy Heritage Company. Mr Yates informed the meeting that a 1902 ‘Arrol Johnson’ car that Earnest Shackleton had brought to the Antarctic, which he estimated would be valued at a six figure sum, had been donated to the Heritage company. The lady involved is coming to Athy for a family wedding in September and Mr Yates highlighted the importance of having the car on display in the Heritage Centre at this time.

1. ADOPTION OF MINUTES.

Minutes of the May Monthly Meeting held on 21st May 2008.

2. MATTERS ARISING

Cllr Wright asked for an update on the Anglers Rest. The Town Clerk advised that a number of weeks had been given for the works and that it would be followed up on.

Cllr Breslin requested an update on the following;

1) a timescale and report on the Nelson Street Houses
2) Item no. 5 – Waterways Ireland Meeting
3) Capital Housing Report

The Town Clerk replied that preliminary work was being done and that a full report would issue at the July meeting on the Nelson St Houses. The manager added that he wanted a detailed analysis of the works as the costings were now significantly higher.

A date is yet to be set to meet with Inland Waterways, Anglers Club, Rowing Club and Canoeing club.

The Capital Housing report is to follow later.




Cllr Daly requested an update on the following;

1) Jetty
2) Graysland Footpath
3) Methodist Church

The Town Engineer noted that no progress had been made since the last meeting on the Jetty and that the footpath is agreed to be part of the Scheme of works in July.

The Town Manager added that a meeting of the Arts sub committee took place the previous night. They are to finalise and come back to the Town Clerk and Town Manager for a meeting next week with regard to the handover.

Cllr O’Sullivan enquired if a letter had issued re the closure of St Vincent’s Hospital and that two lifebuoys were now missing alongside the Barrow. The Town Clerk advised that a letter had issued and there was no reply to date and that he would report the missing lifebuoys to the Town Foreman.

Cllr Lawler enquired about the regulation of the Market and the delisting of No. 9 Duke Street. The Town Manager noted that contact is being made with other local authorities with regard to the Charter. The Town Clerk advised that 4 weeks had to be given to an authority to reply before it could be brought back to the meeting.

Cllr Egan requested an update on the vacant housing units. The Town Clerk informed the meeting that a number of units were being finalised and that some sales were near completion.

3. CORRESPONDENCE

Brian O’Gorman, Town Clerk read the following correspondence:-

· Correspondence from Michael O’Brien, Chairperson of County Kildare Taxi Drivers Association.

The Cathaoirleach suggested that a special meeting be set up to discuss this topic as it was an issue that needed to be addressed in the short term. The Town Manager requested that the Town Engineer could issue a report on the suitable locations in the Town. It was also agreed that this correspondence be brought to the next Joint Policing Committee meeting and that this letter be forwarded to the Gardai to allow them sufficient time to issue a briefing on Taxi Ranks in the town.

· Email from Nick West, Irish Rail following up on the request made by motion raised by Cllr O’Sullivan for the clean up of the area known as ‘The Plots’. Mr West expressed a concern that, by removing the briars in the area, such anti social behaviour will only be encouraged. However, he did note that a specialist rat exterminator would be organised to treat the location.

Cllr O’Sullivan noted that the email was an insult that anti social behaviour was being used as an excuse to not clean up an area. Cllr Daly noted that this land is the responsibility of CIE and they should cleanup the area. Cllr Lawler noted that it was an area that repeatedly comes up on our Tidy Towns remarks. Cllr O’Sullivan requested that a letter issue to CIE expressing our disappointment and concerns. The Town Manager added that this letter should be copied to Barry Kenny also. Cllr Wright noted that a letter issued to CIE re antisocial behaviour on the train and he had not to date received a reply.

· Tom Kelly, Chairman Kildare County Show Society Ltd, 22nd June 2008 in Athy Showgrounds.

The Town Clerk advised the members that Athy Town Council together with Kildare County Council, Athy Civic Amenity Centre and Athy Fire Brigade were taking a stand at the show and would appreciate plenty of support.

The Cathaoirleach noted how it was a very expanded show this year and that it is great to see its return as it was missed last year.

· Macroom Town Council seeking support for motion, “That Macroom Town Council call on the Minister for the Environment Heritage and Local Government to change the law regarding the payment of refuses charges in private rented accommodation. At present this is the duty of the tenants and not the landlord. In a lot of cases the tenants do not have long term contracts so why should they pay annual refuse charges. If a refuse service is provided to tenants they will use it. A small increase in tenants’ rent would off- set the cost to landlords. Fly tipping has become a major national problem and this Council believes that a change in this law would greatly reduce this problem.” This motion has the unanimous support of the members.

· Macroom Town Council seeking support for motion, “That we never forget the appalling tragedy of the Famine, the people who died, those who had to leave our shores in search of a new life and to escape the terrible tragedy of Ireland at the time. In our dramatically changing Ireland it is very important that we remember the history of our country therefore Macroom Town Council proposes that on an annual basis perhaps one of the Public Holiday Mondays be set aside as Famine Remembrance Day.”
This motion has the unanimous support of the members.


· Listowel Town Council seeking support for motion, “That we the Town Council put in place a policy that all our future housing stock for our elderly/living alone be fitted with a “peep hole” in their front doors in doing so giving these tenants a sense of independence and security.”’

5. Councillor Wright:

‘That we as a Council in conjunction with Kildare County Council look at the possibility of widening the road at the left turn from Leinster Street down Kirwan’s Lane as with the school population and the general population of the area is absolutely lethal to all of the people using it’.

Cllr Wright advised the meeting that this was a return for juggernauts and had to be taken seriously. Kildare County Council Roads Design have a responsibility because lives are at risk. Cllr Wright asked that the Council write to the DoEHLG and KCC.

Cllr Egan added that it is lethal and that something should be done. Cllr Lawler added that with the increase in the population and the close vicinity to the school that illegal parking should be addressed here and that it was a bigger matter than just removing a building. Cllr O’Sullivan and Cllr Cunnane supported the motion and asked that the illegal parking be addressed.

‘In view of this fact that in the last two years or more none of the déjà vu motions have been resolved or addressed I propose that we hold a
special meeting to discuss them as going through the ritual of the
motions at every meeting is farcical’

Cllr Wright highlighted that it is important to address things that should have been done years ago. The Cathaoirleach noted that members had previously received progress reports and that he found them very worthwhile. Cllr Lawler suggested that a meeting once a year would be of benefit. The Town Manager advised that a two-year report was being compiled and would be circulated on completion. The Cathaoirleach advised that they would await the report and note how to progress at the July meeting.

That we as a council under the Freedom of Information Act investigate all landlord owned houses in the urban area and supply the names of all as houses are not being kept in proper order and rents should be investigated and also to supply charter on tenants rights’

‘That Athy Town Council request Kildare County Council to investigate the feasibility of providing a pedestrian crossing on Woodstock Street’.

Cllr Egan & Cllr O’Sullivan informed the meeting he was now aware that a study was taking place. Cllr Dalton said it is difficult to pick a location on this street for a crossing and the Cathaoirleach said they would await the outcome of the study.

‘That a report be given on the operation and implementation of the affordable housing scheme’

Cllr Dalton informed the meeting that he was aware of some difficulties and enquired if it was units only now and what the DoEHLG guidelines are now. Cllr Lawler stated there was no need to expand. The Town Clerk informed the meeting that as part of the Housing Strategy and Development Plan that the favoured option is housing, land and then finance. There are currently six affordable units for sale in Gallowhill and 24 coming on stream at Ardrew in late October. Cllr Wright enquired how many affordable units the Town had over the last few years. Cllr Breslin emphasised how units needed to be more affordable. The Town Clerk advised that a report would be prepared.

. ‘Following the investigative survey that was carried out in the sewerage
problems in Leinster Street can the Town Council now issue a report on the findings and what action is too being taken to eradicate the problems’

Both motions number 10 and 16 to be taken together.

Councillor Dalton noted that the Chamber of Commerce were in earlier and expressed an element of surprise that water and sewerage capacities in the town were an issue. He referred to a comment made by former Town Manager Terry O’Niaidh that there was sufficient capacity for 7/8 years. Cllr Dalton enquired to know what discussions, plans and processes were in place to address this. Cllr Lawler said the Town Council needed to be proactive and that the matter should not be further delayed. Cllr Wright noted that the sewerage smell in Leinster Street is going on over 25 years. Cllr Daly reminded the members of a previous motion he had tabled with regard to new water conservation measures. The Town Engineer said he would like to circulate a detailed report on the water and sewerage capacity in the town and the Town Council was nearly at the point of signing the contract for the remediation of the sewerage scheme. Cllr Dalton emphasised the importance of getting a positive message out. The Town Manager noted that motion numbers 10, 12 & 16 could be looked at together and that Directors of Water Services and Transportation, Joe Boland and Des Page, together with the Town Engineer, Paul Hickey would report back to the members. The need to promote confidence and clarity to developers was highlighted. Both Directors are to be invited to attend an Athy Town Council meeting.

‘That this council investigate the noxious odours affecting residents in the William Street/Woodstock area’.

Cllr Dalton remarked that the Environment Section, Kildare County Council needed to be contacted to investigate a prominent local business to address this smell for the benefit of business and domestic people affected as a result. Cllr Lawler noted how he witnessed fluid going across the road and he noted that an EPA licence might be required. The Town Engineer said he had contacted Kildare County Council and would issue a report for the July meeting.

‘Given what now appears to be interminable delays in the construction of the Southern Distributor Road and bearing in mind the importance of this project in the overall development of the town that the Design Team and the consultants be asked to present to the Town Council a realistic and firm timeframe for completion of the project’.

Cllr Daly noted that he tabled this motion in the interest of clarity as this is a very serious project in the town and the timeframe needed to be known. Cllr Lawler noted that the Town Manager had said the Director of Transportation is to attend a meeting shortly and a full briefing on the timeframe of this project should issue. Cllr Dalton informed the members that David Reel had given a presentation to the Area Committee and that whilst this project only commenced in January 2007 the KCC Officials were fully committed to its delivery. Cllr O’Sullivan welcomed the news that an up to date report would issue shortly.

‘That an updated register of derelict buildings and sites be presented to the council with a view to taking decisive action on their current status’.

‘That a Town Council information point be established in the Community Library’.

Cllr Daly noted that a motion was previously passed to put a point in the Town Council and that one could be set up at in the Library to serve the public. Cllr O’Sullivan noted the importance of an information point in Emily Square also.

‘That Athy Town Council would consider erecting ramps in the Dun Brin Estate’.

Cllr O’Sullivan noted that the estate was not taken in charge by the Town Council but requested that ‘Drive carefully/Children at Play’ signs would be erected. Cllr Daly remarked that it was a sad indictment of our road culture. Cllr Lawler highlighted that the onus was on the developer to and that Athy Town Council should have a policy that ramps should be put in all estates and suggested the Town Engineer meet with the developer. The Town Manager supported this.

‘As agreed at the budgetary meeting can the council give a definite date
when the traffic wardens will be provided with handheld machines’.

Cllr Breslin noted that finance was saved when compiling the budget and provisioned for handhelds for the traffic wardens. Cllr Lawler requested a date. The Town Clerk advised the members that €10,000 was provisioned and that he was requesting quotations and would discuss the matter with other authorities.

‘That Athy Town Council in conjunction with Kildare County Council
puts in place measures to eradicate the problem of dumping at Woodstock Street, Athy adjacent to the Health Centre’

Cllr Breslin remarked that dumping in this area is a disgrace. Cllr Lawler asked that contact be made with Kildare County Council and appealed to the public to report illegal dumping as a lot of time is wasted at every meeting talking about it. Cllr Wright supported the motion. The Town Manager noted that he had discussed this with the Town Clerk and Town Engineer and said that a master plan for Flinters Field is due shortly and hoped to have it available for the September meeting.

. ‘That a full report be given on the up to date position regarding the outstanding compliance issues with planning permission in all estates at Rheban Manor and what action is being taken to ensure compliance’.

Cllr Breslin noted that after 8 years of deputations there was multiple issues to be addressed including the pumphouse, sewerage, fencing in lieu of block walls at some units, lack of green areas, vacant units and enquired why the enforcement orders had been lifted. Cllr Breslin remarked how she was deeply ashamed by progress made here and demanded that these bonds be drawn down. Cllr Lawler referred to numerous meetings held on the green areas with the residents and that this developer had treated the members and officials of Athy Town Council with contempt. Cllr Dalton said that at a deputation last summer the residents were to be kept informed of progress and that the current situation was a disgrace. Cllr Wright enquired who was responsible and what was happening at this stage. The Town Manager informed the meeting that he had dealt with a number of developers in his time but never noted this one as the most protracted. He remarked that investigations were taking place and that it would take four weeks to get a full assessment and hoped to have a report for the July meeting. The Town Manager added that he would meet with the residents and move this along adding that they were entitled to a service. The Cathaoirleach said that the Council needed to ensure compliance at this estate.


20. CATHAOIRLEACH’S BUSINESS

The Cathaoirleach expressed his disappointment with the recent IBAL report and congratulated Leixlip and Newbridge on their success. The report is to be thoroughly examined and followed up on.

The Cathaoirleach enquired about ESB and was advised that a representative is to attend the July meeting.

Preliminary work on the Ardreigh Realignment had commenced and asked that the Town Engineer talk to Dave O’Flaherty and the Town Clerk to confirm the route of the footpath. Tarmac is due to be down by November 2008.

Cllr Daly complimented the Council staff on the work completed on the Monasterevin Road.

Cllr O’Sullivan was thanked for her contribution to the Pride of Place, noting that the final is in Waterford this year.

21. MANAGER’S BUSINESS

· Annual Financial Statement 2007 – The Town Manager thanked Helen and Maria and the staff for finalising the AFS.

· Retail Strategy – The Town Manager informed the meeting that the Town Development Plan is a statutory document and that the Retail Strategy is a guidance document and was noted as an objective in the plan.

The members requested that an addendum be noted as follows:

1. The members are assured that the Retail Strategy is an Advisory Document with no statutory import (unlike the Town Development Plan.)

2. All technical definitions and references in the Retail Strategy should be disregarded as all relevant policies are included in the Town Development Plan.

3. The members support a sequential approach suggested in the Retail Strategy and as stated in the Town Development Plan ensuring that adequate time is allowed for the town centre to develop.

4. It is vital for the town that centre- town developments should be prioritised in the granting of planning permission. The creation of a vibrant town centre will act as a catalyst in attracting other services and retail outlets and could lead to critical mass of people which could sustain an evening culture featuring our waterways.

5. It is contingent on the local authority to address the infrastructural issues which could act as impediments or obstacles to centre town development. It is the expressed wish of the elected members that a development takes place in this area developers have been directed towards this area and they must now be assisted in every way to overcome access and other infrastructural difficulties.

The 2008 AGM date was confirmed as 25th June 2008 7.30pm

· Infrastructural Meeting

Cllr Lawler noted that he would not be available between 12th and 25th July and hoped this meeting would take place in early July.

· Financial & Budgetary Review Meeting

No date was set for this meeting.

· The Town Clerk gave an update on the Social Housing Investment Capital Programme as follows:

€4m allocated for 2008.

Current programmes included Ardrew with a total cost of €9.7m to Athy consisting of 87 units, 28 social, 24 affordable due for completion in early 2009 at a cost of €3.34m in 2007.

€1.04m to be taken from Internal Receipts for the Carbury Park Remedial Scheme including 11 private houses, 13 Council units and the construction of 3 new units.

Heating to be set up in approx 100 houses in the Greenhills/Clonmullion area and this project would now be progressed.

Woodstock Lodge is now to proceed to contract stage for contracts to sign in the coming weeks.

Cllr Dalton enquired what the position was in regard to Rheban Manor and Riverview. The Town Manager informed the meeting that as noted by the Town Clerk the €4m. made available is committed.


22. REPORT FROM SUB COMMITTEES

· Athy Town Twinning – Two students are to go to France in July and Jean-Pierre is to visit Athy next weekend for the Kildare County Show.
· Tidy Towns – The Town Clerk is assisting with co-ordinating works.
· Cemetery Committee Meeting – The Cathaoirleach asked that a meeting be set up before the July meeting.
· Athy Swimming Pool – The Town Clerk informed the meeting that this meeting is due to take place on week commencing 30th June.


23. PLANNING REGISTER
Nothing noted.


24. OTHER BUSINESS

Cllr Breslin asked that a cleanup of the green area at the ‘wishing well’ take place as it was very distressing for the deceased members’ family.

Cllr Lawler noted that a one way system needed to be addressed for the road near the sun dial. The Town Engineer has requested an update on the suggested Roads Design from Kildare County Council.

Cllr Wright asked that AIB be contacted to cleanup the wall.

Cllr Wright noted he had discussions with the Town Engineer re a telegraph pole at Clonmullion and requested that a letter issue to the Post Office People.

Cllr Wright complimented the cleanliness of the River Barrow adding that he ate two eels and one trout recently and that it was like it was 40 years ago.

Cllr Egan asked that the Town Engineer investigate loose kerbing going onto Leinster Street at Emily Row.

Cllr O’Sullivan enquired if a ‘No Dumping Sign’ could be erected opposite Avondale Drive.

Cllr Lawler informed the meeting that he was unavailable for the third week in July and requested that the July Monthly meeting be held on the second Wednesday in July.

The Cathaoirleach expressed a vote of sympathy to the wife, daughter and family of Mr Colm O’Ceannabhan, CEO of Co Kildare VEC 1988 to 2002 who passed away recently.

2. MATTERS ARISING

Cllr Wright enquired if the Town Council was still intent on following up on the rent increase.

The Town Manager replied that this was addressed at the last meeting and that considerations were made at budget time. A report is to issue at the June meeting as to the progress of this year’s rent increase.

Cllr Wright asked for update on the derelict site ‘Anglers Rest’. The Town Clerk advised that work had commenced and was to be carried out as requested in the schedule issued.

Cllr Daly requested an update on the Jetty situation and noted that he was anxious that progress be made.

The Town Engineer noted that a reminder request had issued to organise the necessary training for the staff.

Cllr Daly asked if the Health & Safety Report was issued in regard to the Graysland footpath.

The Town Engineer noted that this report was received.

Cllr Egan requested an update on the vacant units.

The Town Clerk outlined the following:

2 houses at Nelson Street – being renovated
1 in Clonmullion – No central heating
2 in Townspark – For Sale
2 in Castlepark – 1 in poor repair and 1 in dispute
3 in Carbury Park – To facilitate the Remedial Scheme

Cllr Dalton noted that some of the vacant units in the area were privately owned and were subject to anti-social behaviour and vandalism. The Town Manager said he would discuss this with the Community Wardens.

Cllr Breslin requested that a report and timescale issue in regard to the central heating in the 9 houses in Nelson Street.

Cllr O’Sullivan requested an update on the lifebuoys. The Town Clerk advised that 3 had been replaced. The Town Engineer added that costings were circulated re. additional buoys.


3. CORRESPONDENCE

Brian O’Gorman, Town Clerk read the following correspondence

§ A request from Cllr Jean-Pierre VASSEUR that 2 persons over 18 were invited to stay in Grandvilliers from 7th to 20th July 2008 through the Young European University. The Town Clerk requested that this correspondence issue to IT Carlow for submissions of persons living in Athy.

§ Invitation to all the members to attend opening of Tri-Athy on Friday 30th May 2008. The Cathaoirleach noted that there were 700 entries last year and to date there was 1500 this year. This is a huge success for the business people in our town and is now a national event.

§ Athy 1798 Monument from Brid Ni Rinn outlining the importance of not downgrading this proposal. A cardboard display of the monument was presented to the members. The Town Engineer noted that this could come in at a significant cost using limestone. Cllr English enquired if there would be agreement to look for sponsorship to progress this project. On the proposal of Cllr English, Seconded by Cllr Daly and all agreed. A report is to issue to the members on receipt of the design drawings from the appointed Civil Engineer.

§ Older Women’s Network (OWN Ireland) requesting to work more closely with local authorities. This correspondence to be circulated to the following: Care of the Elderly, Age Action and RAPID.

§ Notification of the Kildare County Show costing in the region of €100,000. A contribution of €1,000 to issue

Cllr Breslin added that this would be an ideal opportunity to promote Athy Town Council. The Cathaoirleach said this was a very good suggestion and the Town Clerk said he would progress this.

§ Pride of Place to take place on 17th June 2008 at 2.00pm commencing at Travellers Club, Boxing Club and finishing at the CDP for refreshments.

§ People of the Year Awards – Closing Date 1st June 2008. The members requested that this correspondence should issue earlier next year and that a note should be sent to request that more notice be given next year.

§ Request for funding assistance for Athy Unit Kildare Civil Defence to purchase a Manaquan. This correspondence to issue to Kildare County Council and to be deferred to the June meeting.

§ Clonmel Borough Council seeking support for motion, ‘That Clonmel Borough Council ask the Minister for the Environment to overhaul the current driving test, as the current failure rate of 50% is not acceptable and that Cahir Testing Centre or another suitable venue be opened in order to reduce the current waiting time to sit a test which is 6 months or more at present and that this Motion be circulated to all Local Authorities’.

§ Mullingar Town Council seeking support for motion, ‘That this Council calls on the HSE and the Department of Health to improve neurological services in this country as a matter of priority’.
The Cathaoirleach noted that Ireland had 16 neurologists and we should in fact have 38.
The members supported this motion.

§ Passage West Town Council seeking support for motion, ‘A large proportion of motorcycle accidents resulting in serious injury and death are directly related to road conditions and in particular to road repairs. In light of this I would call on this Town Council and all other Councils throughout Ireland to insist that road works be finished to a high standard for all road users, and that in particular the practice of “bedding in” new surfaces be stopped, and adequate warning of roadwork’s be monitored on a daily basis’.
The members supported this motion.

§ Killarney Town Council seeking support for motion, ‘We, in Killarney Town Council, believe the Immigration, Residence and Protection Bill 2008 represents an ideal opportunity to comprehensively reform outdated and inadequate immigration legislation: however, we believe, the bill as it stands, fails to capitalize on this opportunity.
If enacted without significant amendments, the legislation will seriously erode migrants’ rights while at the same time failing to address some of the serious flaws in the system, namely, unacceptable delays in the decision-making process, inconsistent decision making, an over-reliance on the courts to resolve problems and a lack of clarity about the rights, entitlements and obligations of migrants in Ireland. We call on the government to amend the bill accordingly’.
The members noted this.

§ New Ross Town Council seeking support for motion, ‘That this Council calls on the Minister for the Environment to allow Local Authorities to decide housing policy in their respective areas and that we further call on the minister to ensure that the acquisition of land banks for social housing continues as a central plank of housing policy at a local level’.

§ Methodist Church Correspondence to be deferred for the moment pending meeting with Town Manager and relevant parties.

6. “That Athy Town Council initiates a cross community response to the alarming levels of suicide and self-harm in the local area. That local area action plan be drawn up to build resilience or protection at community level; develop crisis intervention services; enhance services and supports for survivors and enhance support for families, individuals and communities affected by suicide and deliberate self-harm.”

Cllr Breslin outlined that the motion was self-explanatory and that Athy had seen its fair share. Cllr Lawler asked if the Town Council could be the host organisation to co-ordinate services. Cllr Dalton wondered where as a local authority we would fit in and added if we could be of any assistance to organisations we should be. Cllr Daly compared that there are more suicides than road deaths and suggested we contact Dan Neville to ask for combined help. Cllr Egan concurred and with increased pressures and job losses more information and assistance is needed. The Cathaoirleach outlined that Schools now have a ‘Critical Incidents Policy’. The Town Manager suggested that this motion be circulated to the CDB as all agencies attend. Cllr O’Sullivan noted that there is a Bereavement Council in the town. The Town Clerk noted 2 actions on the Health Theme under the RAPID programme and suggested that this motion be forwarded to the AIT also.

7. “That Athy Town Council requests Kildare County Council to investigate the possibility of providing a pedestrian crossing at the AIB Bank Duke St.”

Cllr Lawler noted that people are crossing at McStays and requested that the NRA and Town Engineer investigate this. Cllr Breslin added that she does not want to hold up the traffic any further but that this was a dangerous problem and asked that Kildare County Council investigate this further. Cllr English noted a crossing could be a danger at this location at the bottom of the bridge. Cllr O’Sullivan debated the precise location of the crossing.

8. “That Athy Town Council take immediate steps to regulate the Tuesday Market in the areas known as the Barrow Quay, Emily Row and the Back Square and to introduce by-laws if necessary to facilitate this as the areas mentioned have become in recent times dangerous for pedestrians and motorists due to lack of designated market trading areas.”

Cllr Lawler outlined how he had spoken with traders and they have no problem paying a fee and didn’t want to see an end to the market due to the trading on the footpaths. Cllr Breslin said it was getting worse and worse every week. Cllr Egan outlined the difficulties for wheelchair users and the danger of them having to use the road. Cllr Daly outlined he was concerned for the school students as the back square is extremely dangerous. Nobody is regulating the Tuesday market and the Sunday market is working very well. Cllr Dalton said the Town Council is taking a lot of waste away weekly and we needed to make progress on regulating the market. The Cathaoirleach noted his support for the motion. Cllr Lawler added the Charter was for Emily Square only. The Town Engineer suggested that bollards could be placed on some of the paths to assist. The Town Manager advised the members that the Town Clerk would investigate the legalities.

9. “That a review be carried out on all aspects of this council’s housing allocation policies”

Cllr Dalton requested that all members be informed when a casual vacancy is filled. Cllr English spoke in support of the motion stating that it needed to be transparent. Cllr Lawler outlined that it was the practice that a letter was issued in the past at the same time as the offer to the recipient. The Town Clerk outlined the difficulties over the last number of months and agreed that this would be brought into practice.

10. “That additional resources be provided for the upgrade and maintenance of the People’s park.”

Cllr English noted that the playground was becoming dilapidated and upgrading was required. It should be kept as well as the Stradbally playground. Cllr English also added that an eye should be kept on the users and abusers of the park. Cllr Dalton noted that it is a wonderful amenity for the town and that money was provided by RAPID recently. He added that the bins needed to be emptied more regularly. Cllr O’Sullivan concurred and asked that the seating be looked at. Cllr Daly informed the meeting that €66,000 was granted through the RAPID programme. Cllr Lawler asked that the Town Clerk write to the Gardai re. the anti-social behaviour. The Town Clerk and Town Engineer informed the meeting how they had met the RAPID Co-ordinator and that progress would be made with updating the equipment with the funds available.

14. “That Town Council call on the HSE to clarify the position re. services for St Vincent’s Hospital.”

Cllr O’Sullivan requested that we make contact with the HSE re the curtailment rumours and ward closures at St Vincent’s Hospital. Cllr Daly noted how rumours create uncertainty and was worried that the HSE work under a ‘cloak of unaccountability’ for patients and staff of it. Cllr Datlon noted how important that we clarity on this. Cllr Lawler noted how dedicated the staffs of St Vincent’s Hospital are and that the loss of one bed would be unacceptable. Cllr Breslin added if patients were going to be charged for ‘meals on wheels’ it was a disgrace to be targeting the most vulnerable in our society. The Cathaoirleach noted that this was a very serious issue and that clarity was needed.


15. CATHAOIRLEACH’S BUSINESS

The Cathaoirleach requested an update on the road alignment at Ardreigh and spoke about the success of the lunch for the Boxing Club and their Olympian. He suggested that €500 issue to John Joe Joyce and €500 issue to Athy Boxing Club to note this success.

The Cathaoirleach welcomed the news that Athy Garda Station was now to become a single unit and get additional resources and its own traffic corps. He requested a note of congratulations issue to Maurice Flinter to recognise his award for ‘Best Retailer in the Flooring Industry’.


16. MANAGER’S BUSINESS

The Manager gave the follow update on the Road network in the Town:

Ardreigh – Contractor will be on site in next few weeks.
NDR – Route selection is at the final stage. A further meeting will take place in the coming weeks with the Town Council and Area Members.
SDR – CPO process will initiate shortly by the issuing of letters to landowners prior to publication in the newspapers. Funding on this project is a very important issue.
Director of Services, Mr Des Page & Mr Joe Boland have suggested that a meeting be set up shortly to update the members on the Roads/Water & Sewerage projects in the Town.

The Manager reminded the members that the 2 year review/report on the development plan was due to commence and requested the Town Clerk to write to Kildare County Council to initiate this.

Noted that the 1798 monument was already dealt with earlier.

Retail Strategy Update – The Cathaoirleach expressed his disappointment that a date was not yet agreed for this meeting. A date for this meeting is to be pursued.

The 25th June 2008 was set as the date for the AGM.

Delisting of No 9 Duke Street – The Town Clerk informed the members that he was awaiting a further report to proceed with it.

The Manager outlined that the Social Housing Allocation of €4m was welcome and that the first commitment is to Ardrew. The Manager added that a full report will issue to the members for the June meeting and answering Cllr Dalton informed the members there would be no resources available for the purchase of new units.

Finance Sub-Committee Meeting – The Manager outlined that there are a lot of new procedures and would like to invite the Head of Finance down to give a general overview on Finance taking in the role of Directors on companies also. The date of this meeting is to be confirmed at the AGM and would take place early in July.

17. REPORT FROM SUB COMMITTEES

Cllr Lawler informed the meeting that a cleanup of the River Barrow is to take place Saturday and that all members were invited to assist. The weeds and litter in general in the town need to be addressed. Cllr Lawler noted that points increased last year and wants to see that continue. He also added that the onus is on all the people in the town to play their role. Athy Tidy Town’s 5 year plan 2008 – 2013 was circulated and welcomed by the members.

RAPID - Cllr Daly noted that this project was progressing well with the new themes.

YOUTH CAFÉ – The members noted that the building work was looking very well and are looking forward to seeing it up and running.

ATHY TOWN TWINNING – The Town Clerk informed the meeting that the trip two weeks ago was a great success and added that Cllr Jean Pierre was travelling to Athy for the Water festival. Cllr Egan presented a medal and plate as received in Grandvilliers on behalf of the Town Council. The Cathaoirleach extended his best wishes to Cllr Jean Pierre and was honoured to hear the medal was 1 of 10 in the world.

REMEDIAL SCHEME – The Town Clerk noted the positive response received at the progress meeting this afternoon.

CEMETERY – The vacancy of Cllr Noel Scully (R.I.P.) was filled.

MINUTES OF THE APRIL MONTHLY MEETING OF ATHY TOWN COUNCIL HELD AT 7.30 P.M ON WEDNESDAY THE 16th APRIL 2008 IN THE MUICIPAL OFFICES, RATHSTEWART, ATHY.

2. MATTERS ARISING

Cllr Wright enquired why ESB were not in attendance as requested. Cllr Wright also advised the meeting that he wanted an update on the Footbridge and requested a written statement to confirm that it would be constructed.

The Town Clerk advised the members that he received a call this morning to advise him that the representative was unable to attend due to illness.

The Cathaoirleach advised the members that a contact number was left to give to all the members to assist with individual ESB queries.

Cllr Breslin said that to say that funding was applied for to upgrade the heating systems in Nelson Street was misleading and requested an update on the landscaping plan at Kingsgrove.

The Town Engineer advised that all issues would be addressed at the next committee meeting. He advised the members that he received the Safety report yesterday and would issue a recommendation to the Town Manager in regard to this report in the next week/two.

Cllr Daly requested an update on the Jetty and Town Engineer advised that the relevant training had been requested.

The Cathaoirleach informed the meeting that Mr John Lahart was to contact him and in turn the next meeting with regard to the Retail Strategy would be set as soon as possible.

3. CORRESPONDENCE

§ The South Kildare Medieval Festival Sunday 20th April 2008 12.30 – 4.30pm, Emily Square, Athy.

§ A request from ‘Friends of the Elderly, 25 Bolton Street, Dublin 1 to be advised of the oldest person in the locality.

§ A representative from Deputy Jack Wall seeking a contribution to assist a local group called ‘Jekyl’ with recording an EP. Cllr English said he had no objection but that this should be referred back to the Arts Committee.

§ Correspondence from Office of the Minister for Education and Science re ‘Athy Community College’ to advise the members that the recent letter had been brought to the attention of the Minister and the correspondence had been referred to the Developing Areas Section of the Department for direct reply to the Town Clerk. Cllr Daly said there was a huge element of vagueness and was disappointed with this reply. This is the 9th year of this project and he hoped there would be a better response shortly. This was supported by all the members.

§ Correspondence requesting support for Notice of Motion from Mullingar Town Council – ‘That this Town Council would call upon the Minister for Environment, Heritage and Local Government not to disenfranchise local Mullingar town people by preventing them from cutting and saving turf on the local bogs for their own personal use’. All members supported this motion.

§ Correspondence requesting support for Notice of Motion from Clones Town Council – ‘That Clones Town Council note the increase in Agency employment throughout the economy. We are aware that many workers from Ireland and abroad are offered agency employment when they are seeking direct and permanent employment.

We understand that trade unions have raised concern that many of these workers are retained on minimum conditions and in some instances are not receiving their full entitlements.

This Council hereby resolves that Agency employment should not be used as an unnecessary substitute for direct employment or as a mechanism for avoidance of fair pay and conditions.

Noting that legislation will come before the Oireachtas on the issue of Agency Employment, Clones Town Council believe and recommend to the Minister that the Principle of equal treatment should be included in any such legislation on this issue’. All members supported this motion.

§ Correspondence requesting support for Notice of Motion from Clones Town Council – ‘That Clones Town Council call on the Minister for Health, Mary Harney TD to appoint an ombudsman in the Department of Health so that the people of the Country can get an honest answer regarding their complaints about health matters’. All members supported this motion.

§ Correspondence from Athy Town Council Arts Sub committee requesting 2 members of Athy Town Council to make up the proposed Management Company along with 2 representatives from Kildare County Council, 1 from the Methodist Community and 5 from the Arts Committee. Cllr Lawler enquired about the need for 2 members from Kildare County Council and Cllr Daly advised that it was probably mimicking the set up of the Management of the Heritage Company. Cllr Dalton requested the commitment of the Town Manager and the Town Manager advised the members that a letter issued to Mr Shaw. A meeting is to be organised to discuss this in more detail with the Arts Sub Committee and the Town Clerk.

§ Correspondence from Robert Chanders re: Show Band Nostalgic Night in aid of Teach Emanuel Athy, who are raising much needed funds for a new bus.

§ Correspondence from Frank Taaffe enquiring when the 1798 monument would be erected. Cllr Wright said it was scandalous that this monument was not yet erected. Cllr Daly enquired what the current situation was. The Town Engineer advised that a memo was circulated outlining what was needed to proceed and advised that drawings needed to be agreed. Cllr Wright enquired if the three stone tablets in the depot would be used. The Engineer outlined that he currently had an artist’s impression that included these in the design and this needed to be converted into a design. Cllr Lawler met Brid De Rin last year and volunteered to build this monument and had met with the Town Engineer to discuss this. The Town Manager informed the meeting that Athy Town Council had purchased the tablets a number of years ago and enquired if any names were to be part of the design. Cllr Lawler replied that 1798 would be put on it. No other names would be part of the design. Cllr Daly accepted the report as given and asked for an update at the next meeting.

5. “That we as a Council impose a cap on all rent increases on our local authority houses where social welfare recipients and low wages income families are concerned as budget rises are meaning less when this Council takes it from them in rent increases getting from Peter to pay Paul”.

Cllr Wright advised the meeting that Kildare County Council had passed a similar motion re Social Welfare recipients and low income families. Cllr Wright requested that a letter be issued to Minister John Gormley stating that some houses were long overpaid at this stage and the tenant should have an option to purchase them out as a special rate as the most vulnerable people are being hit in our society.

Cllr Egan had nothing further to add.

Cllr Dalton reminded the Council that we had not increased the pensioners and had a minimal rent increase in this year’s budget and requested that the circular re the capping of the increases be checked and asked that a campaign commence to encourage tenant’s to purchase these units. All members spoke in support of this. Cllr Wright requested that the Town Council write to DSCFA and request why pensioners did not have the option to be included in the household budget scheme to pay their rent. Again all members supported this.

6. “That we as a Council look at the possibility in our next estimates of providing money to finance rubbish skips in housing estates when needed, as working class people have genuinely nowhere to dispose non domestic rubbish”.

Cllr Wright informed the meeting that bins were being provided when the Local Authority had no money and now that we have the downturn of the Celtic Tiger we should review and reinstate skips. Some people have no way of getting to the Civic Amenity Centre. It is an embarrassment going on the train due to the litter on view. Dumpers should be prosecuted.

Cllr Lawler supported the motion and spoke of how he doesn’t condone any dumping. Athy has a good civic amenity centre and should have a name and shame Campaign.

Cllr Egan spoke of how Offaly County Council had skips packed high and it was dangerous and maybe a one day cleanup could be organised. Cllr O’Sullivan spoke of how domestic waste being dumped is a disgrace and requested that we write to Kildare County Council to set up an advertisement campaign for the Amenity Centre to encourage more usage. Cllr Dalton spoke in support of advertisement campaign and said we had skips before and they were being set on fire. The community have expressed an interest that they do not want skips. Recycling should be encouraged. Cllr Daly said that recycling should be made easier as dumping at the side of the road was not an easier option and that a solution had to be found. Cllr English supported the motion. The Cathaoirleach noted that the Estimates committee would take this on board in October/November.

7. “That we as a Council take immediate steps under our Derelict Site Act and authority, to either take over or demand a complete cleanup of what is known as the Anglers Rest, Leinster Street, as the filth and dirt and smell coming out of the broken windows is a slight and a blight on our town of Athy”.

Cllr Wright informed the meeting of the smell that was coming from this building stating that there were ‘rats as big as cats in it’, together with anti-social behaviour. He blamed the environmental bodies and requested prosecution immediately.

Cllr Dalton explained that this building was put to the members to delist in order to assist and expressed disappointment that this had not taken place.

The Town Clerk informed the members that a notice had been issued today. Cllr English enquired what would happen now to which the Town Clerk informed the members that different dates were put on the notice for certain works to be completed by. Cllr Wright requested that we write to the Gardai to inform them of the Cider parties that were taken place here. The Town Manager advised the members that this issue had been discussed with the Town Clerk and thought the ‘carrot approach’ could be used and that movement is now afoot.

8. “That the Town Council could replace the lifebuoys on the River especially between Town and Railway Bridge”.

Cllr O’Sullivan informed the meeting that 3 lifebuoys were gone completely and one had no rope attached. This is critical time with the triathlon coming up. Cllr O’Sullivan enquired if two more lifebuoys could be set up near Pettits.

Cllr English supported the motion and condemned the people that threw the lifebuoys in the water.

9. “That Athy Town Council ensures that the pump out station on our waterways is commissioned immediately and put into service to be available for this year’s tourist season”

Cllr Daly requested that this be investigated as this is the only pump station for miles and we are now coming into the tourist season and it was good to encourage people to visit by water.

Cllr Daly informed the meeting that Cllr Wright had a motion in 2006 that had been deferred. The choice was the trees or the path at the time and the residents were now in agreement to reinstate the path. Cllr Daly informed the meeting he had received a letter from Athy Access Group to say that the road was now being used in the absence of the path. This is now an urgent issue coming into the summer season.

Cllr O’Sullivan supported the motion.

Cllr English requested if the motion could be amended to read ‘to defer until report is checked out’. This was supported by Cllr Dalton and put to a vote.

Cllr Wright spoke of how the path must be replaced. Cllr Lawler supported the former Town Engineer as he made a recommendation on foot of the advice available to him at that time and said he would support change if it’s put to the members now. Cllr English said he would abide by whatever the report recommended. Cllr Dalton spoke of how the committee set up has worked well and that they should be contacted when the report recommendations are in place and then be brought back to the members. The Town Manager said he wanted to read the report and would then report back to the members.

Cllr Breslin spoke about the anti-social behaviour and litter in this area. A design under RAPID had been done and had not been finalised. Cllr Breslin requested for the shrubbery to be removed and the paving area to be weeded.

Cllr Lawler supported the motion and said we needed to be proactive as this area had not been cleaned up in a long time. He requested the anti-social behaviour be brought to the attention of the Gardai.

The Town Engineer said he would address this issue.

12. “That a report be given on the reasons for the delay in the starting of a housing development at Woodstock Street, Athy and that in light of the current anti-social behaviour problems that are occurring in the area that further measures be put in place to secure the site”

Cllr Breslin informed the meeting that a tender had been sought, a contractor was appointed and that drink parties were taken place in Woodstock Lodge. This project should proceed now together with a definite time for commencement and for the anti-social behaviour to be eradicated.

Cllr Lawler said he was disappointed that development had not commenced and that he was aware that the contractor appointed had turned down work awaiting commencement of this project.

Cllr Dalton supported this motion. The Town Manager asked that a letter issue to the Gardai in regard to the anti-social behaviour and advised the members that the housing capital allocation for 2008 had not been received yet to know the status of this project.

13. “Can a meeting be arranged between all relevant bodies including the Athy Area Committee to discuss plans and strategy to upgrading and protection of the Barrow Walk in the Athy Area”

Cllr Breslin asked that the Area Committee be involved. The Town Manager highlighted that Inland Waterways were key to this and would be available to meet up with them.

Cllr Dalton requested that a letter issue to Kildare County Council Southern Area Committee to meet with Athy Town Council Members.

14. “That Athy Town Council maintains to an acceptable standard all their vacant houses ensuring that they do not deteriorate or fall into use for anti-social behaviour until such time as they are occupied”

Cllr Egan said this was a very serious matter and that it gives a bad impression.

Cllr Dalton said this is a major issue and that some crime/drug abuse is taking place. The Town Manager said that there is public and private houses concerned here and that a report on the Council properties would issue.

15. “That Athy Town Council immediately erects signs informing the public that it is an offence for dogs to litter in public areas and stating the fines for such an occurrence”

Cllr Lawler supported the motion and said it was difficult to negotiate the footpaths of Athy due to ‘dog dirt’.

Cllr Dalton highlighted that the worst routes were the Carlow Road and the Railway Bridge @ the Kildare Road. Cllr Lawler requested that the sign in the old graveyard be rectified as the ‘no’ part of the ‘No Dogs Allowed’ was deleted. Cllr O’Sullivan asked that signs be put on the Carlow Road. The Town Manager advised that the County Council had Dog Wardens and that Athy Town Council contact Environment Section. The Cathaoirleach requested the location of the current signs around the town.

16. “Can Athy Town Council clean up the walkway by the River Barrow on the Carlow Road as a matter of urgency considering the beauty of the area and how such littering is affecting such amenity”

This motion was deferred to the May meeting.

17. CATHAOIRLEACH’S BUSINESS

The Cathaoirleach asked that the Retail Strategy progress as soon as possible.

The members were advised of the meeting with the 4 Town Councils.

An update was requested in regard to the Arts Committee.

The AMAI had a vote of sympathy for Cllr Noel Scully R.I.P.

A letter was to be sent to Tom Ryan in support of the Green Paper.

The Cathaoirleach extended his congratulations to John Joe Joyce and to Athy Town Boxing Club and yet again to Dom O’Rourke.

18. MANAGER’S BUSINESS

The Manager advised the members that a meeting would be set up to discuss the Retail Strategy and the 2008 Block Grant.

Cllr Daly requested that reinstatement of the right of way at Rathstewart and road markings at this location be part of the Block Grant.

19. REPORT FROM SUB COMMITTEES

ATHY TOWN TWINNING – No report submitted.

ARTS SUB COMMITTEE – A meeting was to be set up, together with the Management Committee re the Methodist Church.

REMEDIAL SCHEME – A submission was being prepared for the DoE on foot of the meeting of Tuesday 15th.

RAPID – Graffiti Removal, Phase I had commenced

YOUTH CAFÉ – The Youth Café was progressing well.

CEMETERY – Cllr O’Sullivan requested if this was still in place and that a section of trees needed to be cut at the Old St Michael’s Cemetery. The Town Engineer to investigate this and the names of the committee to be reconvened.

21. OTHER BUSINESS

Cllr Daly asked if the photo of Cllr Scully R.I.P. had been sourced to put in the Chamber as proposed on Christmas Eve. Cllr Breslin and M Ahearne were following up on this.

Cllr O’Sullivan requested an update re the Bus Shelters in town. The Town Engineer replied that a letter had issued to CIE and that he would issue a reminder.

Cllr Lawler noted that the pole had now gone from the Stradbally Road and requested that the Concrete Bollards now be removed.

The Cathaoirleach proposed a minute’s silence, seconded by Cllr Dalton for the former President Hilary, an exemplary politician and person, to sympathise with his family.
