2. MATTERS ARISING FROM THE MINUTES
Councillor Dalton requested an update on the Retail Strategy. The Town Clerk circulated a memo dated 13th June, 2007 from Marion Chalmers to all councillors.
Councillor Dalton requested an update in regard to the Coneyboro water situation. The Town Clerk read a report from Town Engineer Noel Dillon outlining there was little the Council could do until legal proceedings had decided otherwise. The Town Clerk outlined that the pressure had improved a little since the commencement of leak detection works and that the 11th September, 2007 was the date set for the court. Cllr Dalton requested assurance from the officials that there would not be an adjournment. The Town Manager said he would assist where he could.
Councillor Daly requested an update re: Whitecastle Lawns Boat Slip and right of way in People’s Park. The Town Clerk advised that Mr Donovan had submitted revised drawings and that a special meeting could be organised to discuss further. The Town Clerk also outlined that the Council had a map to say land was not ours to which Cllr Daly requested to know the legal position. The Town Clerk stated it was private land. Cllr Wright stated it was the caretaker’s years ago.
Councillor Daly stated that the IBAL seems to be out of sink and that it was a pity we don’t have an engineer at the moment. He stated it was critically important to keep the sweeping up to date. The Town Manager stated that interviews were held yesterday and the Town Council would have an engineer in a few weeks. The Town Clerk outlined that Athy was participating in Pride Of Place in a number of areas, St Dominick’s Park, CDP, Boxing club, Travellers club and Age Action. Councillor English stated we needed more litterbins in the park and that there were probably six seats without bins. Councillor O’Sullivan noted that a request was made to paint the seats. The Town Clerk said she would investigate. Cllr Wright noted that the park was beautiful and that litter was irresponsible. He requested more tables in the park to which the town clerk replied she would investigate. Councillor Dalton congratulated the progress made at McCauley Park and noted a lot of work had been done.
Councillor Daly requested an update on the swimming pool. The Town Clerk advised that a letter was sent out on the 29th May and that no reply had been received to date. Cllr Wright stated the ambience around the whole new swimming pool was disgraceful and could anything be done to improve the old pool visually. The Town Manager said he would look at this.

Cllr Wright stated that the letter did not mean anything anymore and requested the Town Clerk to write to the new minister, Mr Gormley. Cllr Cunanne stated it was grossly unfair and that it was not social justice to have no discretion in the same way that Bus Eireann and TV Licensing have. Cllr Wright stated that Kildare County Council gives free waivers and now that Athy has development levies we should subsidise.
Confederation of European Councillors hosting a one day Seminar in the Killyhevlin Hotel, Enniskillen, Co Fermanagh on Friday, 29th June, 2007 to focus on ‘Tackling Poverty and Social Need in Ireland, North & South’.
Councillor Dalton informed the meeting that this seminar is now cancelled.

5. “ That we as a Council seek confirmation from Kildare County Council and the Department of Environment that a footbridge will be erected over the barrow at Rathstewart so as to facilitate the people going to our new Swimming Pool and the people in general from the area.”
Cllr Wright stated the footbridge was essential for the town, paths are too narrow for pedestrians and he is awaiting an engineer’s report. It is in the Town Development Plan. It is not a costly job and the people of the town are crying out for it. Cha Chandlers put the motion in and we had no money. We will have a fabulous pool and need a bridge. Cllr Lawler supported the motion and noted it as a vision of the Development Plan and that it would seem the natural option to serve both ends of the town linking the schools, pitches, etc. Cllr Cunanne stated that there was a level of opposition 28 years ago but that it was definitely needed now. Cllr Daly noted to make sure it would be wheelchair friendly. Cllr Dalton remarked that the location of it would be critical. All members supported the motion.
The Town Manager stated that the footbridge is an objective of the Town Development Plan and that other projects are in consideration. The location, design and objective are critical and that Joe Boland, Director of Services would be attending the July Monthly Meeting.

6. “That we as a council look at the possibility of having Kildare County Council and the Department of Health to investigate water pollution in the River Barrow from raw sewage coming from Portarlington and Monasterevan and that in all my years I have never seen the Barrow so filthy”

7. “That in view of the fact that Councils and Corporations around the Country have demolished low cost and old houses so as to provide better houses for their tenants I propose that we look at the possibility of doing likewise with Woodstock Houses and to relocate some and spread others out with consultation with the tenant’s and the Department of Environment as these houses will not stand the test of time”.

8. “That Athy Town Council de-list the property at Number 22 Offaly Street, Athy as the listing of this property is causing great inconvenience for the owner”.
The Town Clerk stated she would start the statutory process.

9. “That the Town Council could provide clothes and plastics bank along the bank at Edmund Rice Square”
Cllr O’Sullivan noted that people had requested it recently and that it would reduce refuse. Cllr Daly noted that recycling should be easy, we need more adequate provision and that the amenity centre is not accessible to all. Cllr Lawler did not support the motion because of the potential of them being set on fire. Cllr English requested if it could be monitored but agreed that if they were burnt they would look unsightly. Cllr O’Sullivan noted that the Bottle Bank in Nurney had a sign on it stating that a donation was being made to The Asthma Society.
The Town Clerk stated that there are alternatives at the moment, St Vincent De Paul being one. Helen noted that they were taken away because they were burnt out. Town Clerk agreed that CCTV could be considered if further funding was made available.

10. “That Athy Town Council erect signage at strategic locations informing people of our bye-laws on drinking alcohol in public places”.
Cllr Daly proposed the motion and noted he was trying to curb drinking illegally in the town and that we are lucky to have byelaws. The Horse Bridge was a particularly bad area. Cllr O’Sullivan noted that Off Licences could be brought into this too. Cllr Cunanne supported the motion and has requested prosecution figures for drinking in public places from the JPC. Cllr Breslin wondered how we could go about introducing a levy on cans. Cllr Lawler stated the role of the publican’s and supermarkets was very important. Cllr Dalton supported the motion fully, it’s a by-product to crime, and litter, anti-social behaviour/suicides and can have an intimidating feeling. Cllr Dalton we currently have a lot of signage that needs to be cleaned.

11. “ That Athy Town Council calls on Kildare County Council to erect ramps on the Kilberry Road entrance to the town to slow down traffic”.
Councillor Daly remarked how cars are travelling at speed coming in from the straight stretch of road and has had a number of complaints from the resident’s of St Joseph’s Terrace. This needed to be addressed urgently. All councillors supported this motion and the need to protect life is important and that ramps are successful in slowing down traffic.
The Town Clerk read a report from Area Engineer.
12. CATHAOIRLEACH’S BUSINESS
The Cathaoirleach thanked Cllr Lawler and all the members for their contribution to the Ceremony for the Privates.
The Cathaoirleach noted that it was important to set a date to discuss the Retail Strategy.
The Cathaoirleach also noted that Cllr English would be 40 years a councillor next month – making him the ‘Daddy of the Chamber’ proposing July 6th or 9th to have a presentation.
Cllr English informed all he was first elected on 28th June, 1967. Cllr Daly said he would be on holidays for both dates unfortunately. All agreed July 6th.
The Cathaoirleach congratulated the Town Clerk on her recent promotion to RAPID co-ordinator. All councillors noted that Linda Mulhall would be a hard act to follow but there was no doubt that Helen would fulfil the role and do a fantastic job. Cllr Cunanne congratulated Helen on behalf of the A.I.T.Cllr O’Sullivan wished Helen all the best and noted how courteous and helpful Helen was at all times. The Town Manager congratulated Helen and was glad she was not leaving the town. The Town Clerk replied by saying she was glad not to be leaving the town and that Athy had been very good to her too.
13. MANAGER’S BUSINESS
AFS 2007 – The Town Clerk noted that the long-term debt was down €145,000 this year and is now at €1.6 m, also stating there would be a six monthly report for the next meeting.

Cllr English raised a query re the Water Collection Rate and was happy with the response that it was an issue in regard to the issuing of the bills and not the customers refusing to pay. The Town Manager thanked the cathaoirleach and members for their support in putting the budget together.
14. REPORTS FROM SUB-COMMITTEES
No reports to note.
The Town Clerk noted that a report on the Heritage, Community Council, Graveyard and Arts would follow at the next meeting.
15. PLANNING REGISTER
Cllr Wright wanted an update on the Shaws file. The Town Clerk stated the file was due next week and that there had been an objection.
Cllr Dalton enquired when we planned to scan the files. The Town Clerk stated she had a meeting next week in regard to this and would keep members informed.
Cllr Cunanne requested clarity on why there would be a planning application for a sub station.
Cllr Dalton queried where we were at in regard to the Development Levy Review. The Town Manager replied that Mr John Lahart is reviewing the County at the moment and Athy would be reviewed as part of this in September/October. The Town Manager noted that the 50% reduction served us well at the time and it is due a review now.
16. ANY OTHER BUSINESS
The Cathaoirleach passed on congratulations to Olive Kavanagh, Audrey Myles and Maria Ahearne for all passing exams recently.
The Cathaoirleach sympathised with the Town Manager on the death of his mother Mrs Nora Skehan.
Cllr Wright requested that a letter be written to the Inland Fisheries in regard to the mound near the Moneen River.
Cllr Wright enquired who is responsible for looking after the nun’s graves at the Carlton site. Sr Brendan Walsh is buried here and he would like it looked after.
Cllr Wright requested to find out who was responsible for the school wall at Convent View. The Town Clerk read a report compiled by the Town Engineer before he left. It was agreed that the Department of Education should be written to.
Cllr Daly conveyed congratulations to the three elected TDs and other members agreed and noted that Cllr Daly’s vote numbers were very good for the first time running.
Cllr Lawler remarked that bins are at times very full in the town and requested that the Town Clerk write to the Model School Board of Management with regard to the dangerous parking on the road instead of using the access system provided by the School.
Cllr Cunanne noted the triathlon was a fantastic success and requested that the organisers be written a letter of congratulations.
Cllr Dalton noted that the river was used on two successive weekends and that the river is underutilised.
Cllr O’Sullivan congratulated Arthur Lynch and his team for the successful triathlon. Cllr O’Sullivan thanked Tidy Towns on the way the square was prepared. The slipway at Dr McDougalds has been cleaned up too and the Town Clerk noted that the rail was on the way.
Cllr Wright requested that AIB be written to, to take away the ‘jungle’ at the front of their premises. Cllr Cunanne supported this and requested the manager be written to and asked to attend a council meeting.
Cllr Dalton noted that Aontas Ogra are 40 years next Thursday and to write a letter to them.
A minute’s silence was observed for the death of Mrs Nora Skehan, mother of Town Manager, Mr Tommy Skehan.

The Cathaoirleach welcomed John Lahart Director of Services for Planning and Aoife Brangan Senior Executive Planner from Kildare County Council who were here to give an update on planning in Athy over the last twelve months
They reported to the members the following:
· That 610 housing units which were granted over the last twelve months
· On the level of planning applications received and processed by Athy Town Council over the same period
· That over the last twelve months the Senior Executive Planner has met with builders and developers when requested and this has been a great success
The regular planning meetings between the Town Clerk and John Lahart and Aoife Brangan.
Cllr Lawler stated that he had seen a major improvement in the level of planning service over the last year.
Cllr Dalton agreed and added that this was evident with the planning application for the Community College which was got out within the six week period.

The Cathaoirleach welcomed PJ Nolan Area representative for the ESB for coming
and outlined to him the problems that this council was experiencing with lighting
repairs, school warning and pedestrians lights and to outline his role in addressing these issues.
Mr. Nolan began by explaining that everything is in flux at the moment in the ESB as it has been broken up into five or six companies under the new regulator and as a result staff are not sure of what they can or cannot do.
Cllr Cunnane stated that he enquired before about the Sub-Station and cables underground and that there was meant to be follow up but nothing ever happened.
Cllr Dalton explained he found the present situation extremely confusing and that some lights have been out of order for months on end specially on the Barrow bridge and wanted to know why this is the case
Cllr Daly stated that this won’t be the last meeting and that the ESB should get its act together.
Cllr O’ Sullivan asked why lighting in urban area was dimmer than on main st.
Cllr Lawler added that he knew of two lights not working in Offaly Street and have been out for some time.
Mr. Nolan replied that:
There is a new computer system been installed and when each local authority sign up to this and the system is up and running any request for repairs should be dealt with a lot more expediently.
Lights off main st are not as bright for privacy within estates.
That where the lights are not working and in need of repair the ESB would go out on a one off and fix them.
That he can be contacted at any time on his ph (which he gave out) or can be e-mailed about any lighting query and added that he would try to find out which company or individual within the ESB dealt with the query and make sure they got back to us as quick as possible so that it could be sorted out.
The Cathaoirleach thanked Mr. Nolan for attending and meeting with the members.

Cllr Dalton enquired why the apartments in Coneyboro for the last three weeks have no water and what action is been taken by this council to rectify this.
Cllr Dalton also requested that something be done about the amount of construction traffic coming in and out of Coneyboro at high speed and that as a result the road is been left in a continual mess
Cllr Lawler added that water would be running freely some weekends and
at other weekends there was none which is totally unacceptable.
Cllr English believed that the onus was on the developer to supply water through water tanks when there is none and that this council ask the developer to
ensure this happens until the problem is rectified.
The Town Engineer replied that the estate was not taking in charge and that we would have to see whether he has complied fully with his planning conditions and if not issue him with an enforcement notice
The Town Engineer also explained that the developer has paid a bond which would cover the clean up of the rd.

2. MATTERS ARISING FROM THE MINUTES
Cllr English enquired why there was very little in the minutes about the ongoing problem at Graysland when it was discussed at some length at the March Meeting.
Cllr O’ Sullivan referred to Motion 7 and 8. The Town Clerk replied that she had been in contact with Barrow Drainage who has informed her that they will do the necessary clean up between Barrow Bridge and slipway before the Triathlon in June of this year.
Cllr Wright stated that he was disappointed with this years St. Patrick’s parade
which was also express by other members present. The Cathaoirleach informed the members that she had been trying to request a meeting with the Chamber of Commerce about this matter but they have never got back to her and will continue along with Town Clerk try to get a meeting set up.
On page two Cllr English should be changed to Cllr Wright. This was noted.
3. CORRESPONDENCE
The Town Clerk read out the following correspondence:
Letter from the Confederation of European Councillors referring to a one day seminar focusing on ‘Building the platform for peace and Prosperity & The Role of Local and Regional Government in North –South Economic Cooperation’ to be held at the Mount Errigal Hotel at 9.00am on the 27th of April with the session commencing at 10.15am and closing with lunch at 1.15pm.
Letter from the John Hewitt Society referring to the John Hewitt International Summer School to be held at the Marketplace Theatre and Arts Centre in Armagh Summer School from the 23-27 July 07
Letter form the IPA referring to a one day seminar focusing on Local Anti- Poverty and Social Inclusion Strategies to be held at the Tullamore Court Hotel on the 30th of April 07 beginning at 9.30am and ending at 3.45pm with closing remarks.

Notion of Motion from Cllr J.J. Power of Naas Town Council at the February Monthly Meeting which states that “ That this Council supports the efforts of everylifecounts.com in their efforts to have just one day each year 21st of Sept World Peace Day where there won’t be any deaths on television for entertainment purposes.” This had the unanimous support of all the members of Athy Town Council
Letter from Kildare County Show Committee explaining that there would be no County Show this year “due to the building developments in and around the Showgrounds in Athy, it would be impossible to run the Show this year.” but that there would be a show next year as the committee “have secured a green field near Athy to host the Kildare County Show in 2008.”

4. ‘That Athy Town Council erects the proposed 1798 Monument immediately.’
Cllrs English wanted to know why it is taking so long to erect the 1798 monument when it should have been done 9 years ago at the time of the commemoration.
Colm Flynn Senior Town Engineer informed the members that a Construction company has agreed to erect the 98 monument free of charge and will do so as soon as possible.
Cllr English enquired on where it would be sited.
Cllr Lawler informed the members that there was a possibility of an alternative site for the monument and asked the members to wait a little longer while he discussed the feasibility of this new location with the Town Engineer and would get back to them as soon as possible. All the members agreed to this.

5. ‘That the upgrade of the pathway between St. John’s Lane and Greenhill be carried out as a matter of urgency’.
Cllr Dalton wanted to know when the above works are to begin
Colm Flynn, Senior Town Engineer explained that he had checked the pathway and found nothing wrong with.
Cllr Dalton disagreed and believed it was an “eye sore”.
However the Town Clerk added that there was some funding under the Rapid Scheme which could be drawn down and used to upgrade the pathway and that she would get in contact with Linda Mulhall and come back to the members at the next Monthly Meeting with an update.

6.‘That Kildare County Council address as a priority the increased traffic volumes entering the N78 from Fortbarrington Rd and that adequate Traffic controls are introduced’.
Cllr Dalton stated that he wanted pressure put on Kildare County Council from this Council to put adequate traffic controls in place as a matter of urgency.
Cllr Cunnane added that he had this particular motion down on several occasions and didn’t want repeat of Kildare Road Saga.
Noel Dillon Town Engineer informed the members that he will talk to Dave O’ Flaherty; Area Engineer for Kildare County Council to see what could be done and will come back to the members at the next Monthly Meeting.

7. ‘That this Council expresses its disappointment at the unacceptable delay in delivery of major projects for Athy. Athy Community College, Athy Community Swimming Pool and the decentralized Revenue office have all suffered unnecessary delay and this council must commit to challenging these delays.’
Cllr Daly stated that he found it quite annoying in the time it is taking to make progress in the delivery of the major projects promised for Athy and added that there should be a time frame and some accountability for any delays in future projects
Cllr Cunnane said that as Chairperson of Kildare VEC he was delighted that the new Athy Community College was on its way but still found it unacceptable the length of time it is taking to deliver on these projects.
Cllr Lawler welcomed the moving of Revenue to Athy and didn’t care whether it was on the Dublin Rd or Naas Rd
Cllr Dalton stated that Athy would be getting a new Swimming Pool before Naas and added that it was through the work of three members of this council that brought Athy Community School project back to life
Cllr Dalton said that this was evident through the reps they had made and which are now on file and claimed that this should be compared with the reps on file from Cllr Daly on this particular project which were non existent

8.‘That this council calls on Kildare County Council to appoint the ISPCA Inspector an authorised officer under the Control of Dogs Act 1986 and the Control of Horses Act 1996’.
Cllr Daly stated that some dogs were living in dangerous and bad conditions and maybe involved in dog fighting and there call ISPCA Inspector should be appointed immediately by Kildare County Council to ensure the protection and well being of these animals.

Cllr O’ Sullivan stated that this motion was before this council three times over the last four years and therefore could not understand why nothing was ever done as little work would be required to put up hand rails and improve the surface of the walk
Cllr Cunnane complimented Cllr O’ Sullivan for her perseverance on this motion.
The Town Clerk explained that work would be carried this year including installing of hand rails as requested.
9. Cathaoirleach’s Business
The Cathaoirleach informed the members present of the Athy Retail Strategy Meeting which was on the 26th of April 07.
The Cathaoirleach official welcomed Noel Dillon as the council’s new Town Engineer. This was endorsed by all the members.
The Cathaoirlach explained that access over the bridge was extremely difficult specially for the elderly, people with buggies and wheelchair users, due to the state of the surface and added that a small amount of work would only be required to rectify this problem and asked that work be carried out as soon as possible re
The Town Clerk will discuss this with Town Engineer and come back to the members at the next Monthly Meeting.
The Cathaoirleach asked that a letter be forwarded to Linda Mulhall on behalf of this council, thanking her for the hard work and commitment she had shown when she was employed as RAPID Coordinator for Athy and to wish her well in her new job. This had the support of all the members’ presents.
The Town Clerk stated that a presentation would be made by staff on Friday 20th at 4pm and all members are welcome.

The Town Manager informed everyone that Mr. Malone has taken up his new position as County Manager for Kildare County Council
The Town Clerk stated that she was surprised in the amount of Contractors that have applied for the Tenders for new Residential Scheme for Woodstock and that the closing date was set for the 10th of May 07.
The Town Clerk hoped that the Ardreigh Project would begin within the next month.

That the footpaths would be extended out to Cuan Mhuire but would be narrower than the norm due to width of the road.

Cllr Noel Scully enquired when the council would be getting new Litter Warden.
The Town Clerk replied that an interview Panel was been set up and that interviews would begin quite soon and that hopefully the successful candidate would start work as soon as possible.
Cllr Cunnane requested a report for the next monthly meeting showing what our income in parking fines over the first four months.
Cllr O Sullivan stated that there was some dumping out past Cuan Mhuire and asked that this would be cleared up and
Also Cllr O’ Sullivan added that there would be a choir reception in Athy Town Council Chamber and all were invited
The Town Clerk explained that this area was covered by Kildare County Council and that she would get in contact with their Litter Warden for that area.
Cllr Daly stated that cars are been parked all over the place in St Michael Tce and as a result access is extremely difficult.
The Town Clerk said that she would look again at the Car Parking Bye-Laws 2005 and see what could be done but in the interim will ask the Traffic Warden to keep an eye on the parking in this area.

The Cathaoirleach welcomed John Lahart Director of Services for Planning and Aoife Brangan Senior Executive Planner from Kildare County Council who were here to give an update on planning in Athy over the last twelve months
They reported to the members the following:
· That 610 housing units which were granted over the last twelve months
· On the level of planning applications received and processed by Athy Town Council over the same period
· That over the last twelve months the Senior Executive Planner has met with builders and developers when requested and this has been a great success
The regular planning meetings between the Town Clerk and John Lahart and Aoife Brangan.
Cllr Lawler stated that he had seen a major improvement in the level of planning service over the last year.
Cllr Dalton agreed and added that this was evident with the planning application for the Community College which was got out within the six week period.

The Cathaoirleach welcomed PJ Nolan Area representative for the ESB for coming
and outlined to him the problems that this council was experiencing with lighting
repairs, school warning and pedestrians lights and to outline his role in addressing these issues.
Mr. Nolan began by explaining that everything is in flux at the moment in the ESB as it has been broken up into five or six companies under the new regulator and as a result staff are not sure of what they can or cannot do.
Cllr Cunnane stated that he enquired before about the Sub-Station and cables underground and that there was meant to be follow up but nothing ever happened.
Cllr Dalton explained he found the present situation extremely confusing and that some lights have been out of order for months on end specially on the Barrow bridge and wanted to know why this is the case
Cllr Daly stated that this won’t be the last meeting and that the ESB should get its act together.
Cllr O’ Sullivan asked why lighting in urban area was dimmer than on main st.
Cllr Lawler added that he knew of two lights not working in Offaly Street and have been out for some time.
Mr. Nolan replied that:
There is a new computer system been installed and when each local authority sign up to this and the system is up and running any request for repairs should be dealt with a lot more expediently.
Lights off main st are not as bright for privacy within estates.
That where the lights are not working and in need of repair the ESB would go out on a one off and fix them.
That he can be contacted at any time on his ph (which he gave out) or can be e-mailed about any lighting query and added that he would try to find out which company or individual within the ESB dealt with the query and make sure they got back to us as quick as possible so that it could be sorted out.
The Cathaoirleach thanked Mr. Nolan for attending and meeting with the members.

Cllr Dalton enquired why the apartments in Coneyboro for the last three weeks have no water and what action is been taken by this council to rectify this.
Cllr Dalton also requested that something be done about the amount of construction traffic coming in and out of Coneyboro at high speed and that as a result the road is been left in a continual mess
Cllr Lawler added that water would be running freely some weekends and
at other weekends there was none which is totally unacceptable.
Cllr English believed that the onus was on the developer to supply water through water tanks when there is none and that this council ask the developer to
ensure this happens until the problem is rectified.
The Town Engineer replied that the estate was not taking in charge and that we would have to see whether he has complied fully with his planning conditions and if not issue him with an enforcement notice
The Town Engineer also explained that the developer has paid a bond which would cover the clean up of the rd.

Cllr English enquired why there was very little in the minutes about the ongoing problem at Graysland when it was discussed at some length at the March Meeting.
Cllr O’ Sullivan referred to Motion 7 and 8. The Town Clerk replied that she had been in contact with Barrow Drainage who has informed her that they will do the necessary clean up between Barrow Bridge and slipway before the Triathlon in June of this year.
Cllr Wright stated that he was disappointed with this years St. Patrick’s parade
which was also express by other members present. The Cathaoirleach informed the members that she had been trying to request a meeting with the Chamber of Commerce about this matter but they have never got back to her and will continue along with Town Clerk try to get a meeting set up.
On page two Cllr English should be changed to Cllr Wright. This was noted.

Letter from Kildare County Show Committee explaining that there would be no County Show this year “due to the building developments in and around the Showgrounds in Athy, it would be impossible to run the Show this year.” but that there would be a show next year as the committee “have secured a green field near Athy to host the Kildare County Show in 2008.”

Cllrs English wanted to know why it is taking so long to erect the 1798 monument when it should have been done 9 years ago at the time of the commemoration.
Colm Flynn Senior Town Engineer informed the members that a Construction company has agreed to erect the 98 monument free of charge and will do so as soon as possible.
Cllr English enquired on where it would be sited.
Cllr Lawler informed the members that there was a possibility of an alternative site for the monument and asked the members to wait a little longer while he discussed the feasibility of this new location with the Town Engineer and would get back to them as soon as possible. All the members agreed to this.

5. ‘That the upgrade of the pathway between St. John’s Lane and Greenhill be carried out as a matter of urgency’.
Cllr Dalton wanted to know when the above works are to begin
Colm Flynn, Senior Town Engineer explained that he had checked the pathway and found nothing wrong with.
Cllr Dalton disagreed and believed it was an “eye sore”.
However the Town Clerk added that there was some funding under the Rapid Scheme which could be drawn down and used to upgrade the pathway and that she would get in contact with Linda Mulhall and come back to the members at the next Monthly Meeting with an update.

6.‘That Kildare County Council address as a priority the increased traffic volumes entering the N78 from Fortbarrington Rd and that adequate Traffic controls are introduced’.
Cllr Dalton stated that he wanted pressure put on Kildare County Council from this Council to put adequate traffic controls in place as a matter of urgency.
Cllr Cunnane added that he had this particular motion down on several occasions and didn’t want repeat of Kildare Road Saga.
Noel Dillon Town Engineer informed the members that he will talk to Dave O’ Flaherty; Area Engineer for Kildare County Council to see what could be done and will come back to the members at the next Monthly Meeting.

7. ‘That this Council expresses its disappointment at the unacceptable delay in delivery of major projects for Athy. Athy Community College, Athy Community Swimming Pool and the decentralized Revenue office have all suffered unnecessary delay and this council must commit to challenging these delays.’
Cllr Daly stated that he found it quite annoying in the time it is taking to make progress in the delivery of the major projects promised for Athy and added that there should be a time frame and some accountability for any delays in future projects
Cllr Cunnane said that as Chairperson of Kildare VEC he was delighted that the new Athy Community College was on its way but still found it unacceptable the length of time it is taking to deliver on these projects.
Cllr Lawler welcomed the moving of Revenue to Athy and didn’t care whether it was on the Dublin Rd or Naas Rd
Cllr Dalton stated that Athy would be getting a new Swimming Pool before Naas and added that it was through the work of three members of this council that brought Athy Community School project back to life

2. MATTERS ARISING FROM THE MINUTES
Cllr Lawler noted correction to Motion 6 to say ‘without water’
Cllr O’Sullivan enquired if there had been any word from Iarnrod Eireann. Town Clerk that no correspondence was received and will write to Iarnrod Eireann to request promised report together with an update on the motion discussed.
Cllr O’Sullivan requested report on Meeting Lane and was advised by Town Engineer that Block Grant allocation was not complete.
Cllr Wright expressed that the statement ‘was well aware’ in regard to money for skips being unavailable was sarcastic. Town Clerk advised that this was as it was stated at the February meeting.
Cllr Daly requested an update on the HGV and Town Clerk advised this has been addressed.
Cllr Daly requested update on the swimming pool to which the Town Clerk read a report from Leisure Services saying that contracts were to be signed in the next few days and the contractor will be taking possession of the site on 16th April with a view to commencing works thereafter. Cllr Daly requested that a meeting be organised to bring the residents up to date by the committee elected at February meeting.
Cllr English asked if the footbridge across the river would be part of the swimming pool project. The Town Clerk informed Cllr Wright that the bridge did not coincide with the swimming pool but could be raised with Joe Boland.
Cllr Cunnane requested the Minutes of the meeting on the Thursday 8th. Town Clerk apologised due to work pressures and advised that they will issue.

Tri Athy 2007 Report - 370 people are now registered
Cllr English enquired if a reception should be arranged for the Triathlon and the Cathaoirleach informed all members that Arthur Lynch will be in contact. The Town Clerk suggested that the Town Engineer could assist with a number of items.
From Historic Monuments Advisory Committee re Athy 1798 Monument – Cllr Lawler advised that he would meet with Town Engineer to discuss location and erection of same.

Cllr Wright enquired if there was any correspondence from Social Welfare in regard to subvention. The Town Clerk advised she had not received any but would issue further correspondence to enquire.
Cllr O’Sullivan noted that she attended a conference on 3rd March and would give a report after the meeting if requested.
4. NOTICES OF MOTION
The Cathaoirleach suggested that she would read a report on the Meeting held with Graysland Resident’s Association Committee at 7.30pm on 20th March as per discussions at the February meeting of Athy Town Council.
All members of the Resident’s Association attended the meeting and it was chaired by Cllr Breslin.
A background was given in relation to the footpath;
Ø In 2005 Roy Kelly suggested the trees to the RHS of footpath were to be removed as their roots were damaging the footpath. The committee requested that no work would commence.
Ø On Holy Thursday, 2006 Mr Timoney was informed that removal of trees was to take place in the next 7 days.
Ø Two options were made to Mr Timoney and Mr Ger Kelly from the Resident’s Association.
1. To remove the trees and re-instate the footpath
2. To remove the footpath and reinstate the footpath on the opposite side of the road.
Ø Meeting of the Resident’s Association was held on 18th April, 2006 where 14 persons were in attendance. A vote was held on the two options put forward by the engineer. 12 residents are voted in favour of keeping the trees and reinstating the path on the other side of the road. 2 residents are voted against.
Ø Correspondence issued to the Town Clerk to advise of same.
Cllr Breslin asked were the committee members and officers happy with the work that was carried out and she was informed that they all were.
The Cathaoirleach advised that she was not conducting business like the last meeting and asked for order. Cllr Lawler suggested that too much time had been spent on this issue. Cllr English emphasised the right the Cathaoirleach had to meet any association on behalf of the Council and that it had been agreed at the last Council meeting. 4. “That in view of the fact that this Council has allowed a new private housing estate through the peace and tranquility of Kingsgrove and Graysland causing a dangerous situation for both estates, I propose that we immediately reinstate the path that was so controversially removed for the safety of all residents in the area as this is a new departure and obviously not envisaged before the path was removed.”
Cllr Wright requested reinstatement of the path for the safety of the people and presented photos of children on the old path and the road. He questioned the Engineer’s decision and requested if anyone had objected to the illegal fence erected by Mr Timoney.
Cllr Daly addressed that the issue should be dealt with as it was splitting the community and requested an Independent Audit for Health & Safety reasons. He added that he did not like underhand comments and that members refrain from personalising comments.
Cllr Cunnane expressed concern in regard to naming resident and queried if there could be a footpath put in on each side of the road.
Cllr Wright advised that legal action had been taken and details had gone to the Solicitor.
The Town Engineer stated that where possible it was a better option not to cut down trees. The Resident’s Association had been notified. A poll has been repeatedly requested and not submitted to date. If further development is to take place at this location a traffic management plan is to be submitted.
Cllr Wright requested if a second path would go in if the developer got full approval to which Mr. Skehan that an answer could not be given on this at the moment as an independent traffic audit to take place. The Town Engineer advised that analysis of the area at the moment deemed it safe.
Cllr Wright suggested a plebiscite be set up and then asked that the notice of motion be withdrawn until traffic management report issued. The Cathaoirleach confirmed that the motion had been withdrawn.

Cllr Lawler that this was being studied per the JPC and will be reported on by Roads Design at the next meeting and was premature at this time.

Cllr Cunnane stated that this road needed a serious upgrade and was very dangerous at the present time. He requested that it be addressed with a temporary solution and in time, a permanent one that would take a footpath into account together with the road being widened.
All Councillors spoke in favour of this motion in the interest of safety. The Town Clerk advised the road is being maintained by Kildare County Council and that it is listed in 2008 programme of works. The Town Engineer noted that the Development Levy Charges should be reviewed promptly.

Cllr O’Sullivan expressed her support for the Triathlon in Athy this June and the possibility of the president visiting for the close of the Year of the Barrow in Athy in October. Cllr O’Sullivan said it was terrible to see a seat turned over into a drain and an oil tank abandoned.
Cllr Scully requested that more signage be erected.
The Town Clerk said she had spoken to the Town Engineer and was looking at upgrading the base of Mill Lane for the Triathlon and would be issuing correspondence to the Barrow Drainage and OPW.

Twinning Update: Meeting yesterday, 37 people coming over and a schedule is being put together.

2. MATTERS ARISING FROM THE MINUTES
Cllr Lawler noted correction to Motion 6 to say ‘without water’
Cllr O’Sullivan enquired if there had been any word from Iarnrod Eireann. Town Clerk that no correspondence was received and will write to Iarnrod Eireann to request promised report together with an update on the motion discussed.
Cllr O’Sullivan requested report on Meeting Lane and was advised by Town Engineer that Block Grant allocation was not complete.
Cllr Wright expressed that the statement ‘was well aware’ in regard to money for skips being unavailable was sarcastic. Town Clerk advised that this was as it was stated at the February meeting.
Cllr Daly requested an update on the HGV and Town Clerk advised this has been addressed.
Cllr Daly requested update on the swimming pool to which the Town Clerk read a report from Leisure Services saying that contracts were to be signed in the next few days and the contractor will be taking possession of the site on 16th April with a view to commencing works thereafter. Cllr Daly requested that a meeting be organised to bring the residents up to date by the committee elected at February meeting.
Cllr English asked if the footbridge across the river would be part of the swimming pool project. The Town Clerk informed Cllr Wright that the bridge did not coincide with the swimming pool but could be raised with Joe Boland.
Cllr Cunnane requested the Minutes of the meeting on the Thursday 8th. Town Clerk apologised due to work pressures and advised that they will issue.
3. CORRESPONDENCE
Tri Athy 2007 Report - 370 people are now registered
Cllr English enquired if a reception should be arranged for the Triathlon and the Cathaoirleach informed all members that Arthur Lynch will be in contact. The Town Clerk suggested that the Town Engineer could assist with a number of items.
From Historic Monuments Advisory Committee re Athy 1798 Monument – Cllr Lawler advised that he would meet with Town Engineer to discuss location and erection of same.

4. NOTICES OF MOTION
The Cathaoirleach suggested that she would read a report on the Meeting held with Graysland Resident’s Association Committee at 7.30pm on 20th March as per discussions at the February meeting of Athy Town Council.
All members of the Resident’s Association attended the meeting and it was chaired by Cllr Breslin.
A background was given in relation to the footpath;
Ø In 2005 Roy Kelly suggested the trees to the RHS of footpath were to be removed as their roots were damaging the footpath. The committee requested that no work would commence.
Ø On Holy Thursday, 2006 Mr Timoney was informed that removal of trees was to take place in the next 7 days.
Ø Two options were made to Mr Timoney and Mr Ger Kelly from the Resident’s Association.
1. To remove the trees and re-instate the footpath
2. To remove the footpath and reinstate the footpath on the opposite side of the road.
Ø Meeting of the Resident’s Association was held on 18th April, 2006 where 14 persons were in attendance. A vote was held on the two options put forward by the engineer. 12 residents are voted in favour of keeping the trees and reinstating the path on the other side of the road. 2 residents are voted against.
Ø Correspondence issued to the Town Clerk to advise of same.
Cllr Breslin asked were the committee members and officers happy with the work that was carried out and she was informed that they all were.
