Minutes of September Monthly Meeting held on the 16th September, 2009.

Minutes of Vote of Sympathy meeting held on the 26th of Aug, 2009
Proposed by Councillor Redmond, seconded by Councillor Wall.

Councillor Lawler said that on behalf of his family and himself, he would like to thank his colleagues and staff of the Council, for their kind words and expression of sympathy conveyed to him and his immediate family, upon the recent passing away of their mother.

Matters Arising.

Councillor Wright sought an update on the Porta Cabins at the local school. The A/Town Clerk advised the members that the Council had previously written out to the Department of Education on this matter but are still waiting on a reply and will follow up again.

Councillor Wright also sought an update on the provision of transport for students to the new schools on the Monasterevin Road. The A/Town Clerk advised the members that the Council had also previously written to the Department of Education on this matter but are still waiting on a reply and will follow up again.

Councillor Wright sought an update on the artefacts discovered during the road works at Ardreigh. The Town Manager advised the members, that any finds on an archaeological dig, automatically becomes the property of the National Museum, and in due course, will be put on public display, and that photos of these artefacts would be obtained by the Council for the members.

Councillor Wright sought an update on the wording of the “prohibiting of consumption of alcohol in public parks” signs in the peoples’ park. The Town Engineer advised the members that the wording on the signs would be checked and will report back at the next monthly meeting.

Councillor Redmond sought an update on motion 12 (Re. bicycle terminals) The Town Manager advised the members that this proposal was forwarded, to the Roads Design Office in Kildare County Council, to be included and incorporated, in the drafting of the Athy Traffic Management Plan.

Councillor Wall sought an update on the purchase of a new mulching kit for the existing lawnmower. The Town Engineer advised the members that the Council do not have the necessary monies to purchase this equipment but that due consideration would be given to this when Council finances permit it.

Minutes of Special Meeting for Civic Presentation to the Rose of Tralee held on the 3rd of September, 2009
Proposed by Councillor Mahon, seconded by Councillor O’ Sullivan.

Draft Traffic Management Plan - Part 8 (Donal Hodgins, Senior Executive Engineer to attend.)
The Town Manager advised the members that the SEE could not be in attendance, to give an up-to date briefing as planned, due to personal circumstances, and requested that this be deferred till next month.

It was agreed by all the members that it would be deferred until October monthly meeting.

Nomination to Cill Dara ar Aghaidh Teoranta
On the proposal of Councillor Mahon and seconded by Councillor Wall, and with the unanimous agreement of the other members, the Cathaoirleach, was duly nominated to Cill Dara ar Aghaidh Teoranta.

To receive up-date regarding 2009 Housing Capital Programme
The Town manager gave an up-to-date briefing to the members on what Capital housing projects/remedial works have been completed so far in 2009 and what housing works the Council, hope to undertake in the future.

The members were unanimous in their praise and appreciation of the hard work done by staff members in the completion of remedial works to date.

Audited Annual Financial Statement 2009
This was noted by the members.

Planning and Development Act 2000- List of Protected Structures
- To consider list of protected structures:
A) Upper William Street
B) 12 Emily Square
The Town Manager advised the members that a report on the relevant structures was presently been prepared by the Conservation Officer in Kildare County This was circulated along with relevant files. It was resolved that the proposed delisting would proceed to the formal public consultation stage in accordance with the terms of the Planning and Development Act 2000.

To note special meeting/civic reception to honour the 2009 Rose of Tralee.
The members were unanimous in congratuling Charmaine Kenny on been selected as the Rose of Tralee for 2009.

Correspondence.
The A/Town Clerk read out all relevant correspondence received since the previous monthly meeting, which was duly noted by the members.

Notices of Motion.

Councillor Dalton
“That the footpath at Janeville be upgraded.”

On the proposal of Councillor Dalton, seconded by Councillor Lawler

Following a discussion by the members their was unanimous agreement that the necessary upgraded work on the footpath be carried out as soon as possible. This was noted by the Town Engineer.

14. “That this Council recommends a Yes vote in the Lisbon Treaty Referendum.”

On the proposal of Councillor Dalton, seconded by Councillor Lawler

The Cathaoirleach requested a vote on this motion. Seven members voted in favour of this motion and one member vote against this motion. This motion was duly carried and passed.

Councillor Wright
“That in view of the fact that Athy is a heritage town and also that old St. Michael’s cemetery is also part of our heritage, I propose, that in view of the disgraceful state of the cemetery that we take immediate steps to have it cleaned up, as it is a slight and blight on this Council and town, and that while cemeteries all over the country have FAS employees working in them, this should also apply to Athy.”

On the proposal of Councillor Wright, seconded by Councillor Redmond.

Following a discussion on this motion the members were unanimous in complimenting the current caretaker for his continuous hard work in the upkeep and maintenance of the local cemeteries and also requested that a meeting of the Cemetery Committee be held as soon as possible.

“That we as a Council pursue a search in the land registry as to the owner of the lands from St. John’s Lane to Greenhill’s because it is in a filthy state and beside a school and a housing estate, and should be cleaned up.”

Following a discussion on this motion the members agreed that a search in the land registry be carried out by Council officials to determine who the ownership of the area in question.

The Town Engineer advised the members that this would be carried out as soon as possible and also the litter warden would patrol the area in question on a regular basis

The Cathaoirleach also proposed that the Council liaise with RAPID to look at the possibility of obtaining some funding to clean up the area in question.

“That we as a Council look at the possibility of removing the old wall between Carbery Park and Dooley’s Terrace as it is in a terrible state of dereliction and is also been used as a dump which is totally unfair to the residents of Dooley’s Terrace and Carbery Park, where recent remedial works have been carried out.”

Following a discussion on this motion it was agreed that this council should look at the possibility of removing the wall in question as one way of stopping continuous illegal dumping in this area

The Town Engineer advised the members that the litter warden would patrol the area in question and all viable option would be looked at.

It was agreed by the members that motions’ 18 and 24 would be taken together

18. “That Athy Town Council voices its disappointment at the proposed closure of wards in St Vincent’s Hospital, Athy and Naas General Hospital to the HSE.”

24. Councillor, Mahon, Redmond and Wall
“That Athy Town Council calls on the HSE to reverse its decision to close a 26 bed ward at St Vincent’s Hospital, considering the affect that such a closure will have on patients and their families and, indeed the staff of the Hospital.”

On the proposal of Councillor Mahon, seconded by Councillor Wall

Following a comprehensive discussion on this motion the members agreed that the HSE be written out to, in quite clear and emphatic terms, demanding that the decision to close the bed wards in St Vincent’s Hospital be immediately reversed and that these wards be kept open.

The A/Town Clerk advised the members that letter conveying their wishes on this matter would be forwarded to the HSE as soon as possible.

The Cathaoirleach advised the members that a march in protest against these ward closures was organised for 2pm on September the 26th and that it was imperative that all members show a united front on this issue and attend this march. This had the support of all the other members.

Councillor Daly
19 “That Athy Town Council examine the provision of safe cycle routes to the new education campus on the Monasterevin Road.”

On the proposal of Councillor Daly, seconded by Councillor O’ Sullivan.

Following a discussion on this motion it was agreed that the Council should look at the possibility of putting in place safe cycles routes for students going to and coming from the new schools on the Monasterevin Road.

The Town Engineer said he would liaise with the Area Engineer on this matter and would revert back to the members in due course.

20. “That Athy Town Council engages with Kildare County Council to ensure speedy completion of the perimeter wall and road upgrading at the new swimming pool.”

On the proposal of Councillor Daly, seconded by Councillor O’ Sullivan

Following a discussion on this motion it was agreed that this Council should ensure that the perimeter wall and road upgrade at new swimming pool be immediately completed by Kildare County Council and this Council should liaise with them to ensure that this work is completed to everyone’s’ satisfaction.

The Town Manager advised the members that he would liaise with Director of Services for Sport and Leisure in Kildare County Council to ensure work in question is completed.

“That Athy Town Council addresses the issue of slowing traffic on the Fortbarrington road where the Ardrew development has taken place.”

On the proposal of Councillor Daly, seconded by Councillor O’ Sullivan.

Following a discussion on this motion the were unanimous in agreement that any outstanding traffic issues in relation to the Ardrew development be addressed as soon as possible. This was noted by the Town Engineer.

“That Athy Town Council establishes a sub-committee to examine current Standing orders and the structure and remit of sub-committees.”

Following a discussion on this motion the members were unanimous in their agreement that a review of the present format and area of responsibility for existing sub-committees, along with present standing orders, be carried out as soon as possible.

The Town Manager advised the members that the Local Government Act gives ample discretion and control to local authorities in the overall operation of sub- committees, and that also he would distribute at the next month’s monthly meeting a list of current existing sub-committees.

23. “That necessary action including serving a derelict order be taken by Athy Town Council to ensure that Kildare County Council restores the vacant premises in meeting Lane.”

On the proposal of Councillor Redmond, seconded by Councillor Wall.

Following a discussion on this motion the Town Manager advised the members that, the Clerk of Works would liaise with Kildare County Council on this issue and would revert back to the members on this matter in due course.

25. Cathaoirleach’s Business

The Cathaoirleach advised the members that it was imperative that this Council takes the lead and is involved in all aspects of the SHINE Project. This had the support of the other members.

The Cathaoirleach advised the members that the Council would have a stall at the forthcoming Ploughing Championship, and whilst this will largely be staffed by Council employees, it was important that Council members give some of their time to be at the stall.

The Cathaoirleach on behalf of herself and the other members congratulated Councillor O’ Sullivan on her recent appointment as President of Athy’s Lions Club. Councillor O’ Sullivan thanked the members for their kind words

The Cathaoirleach advised the members that the houses at Ardrew have been allocated, and on behalf of herself and her colleagues, would like to thank and compliment the staff of this Council for their hard work in ensuring that the involved was these house were duly allocated

The Cathaoirleach advised the members that a dinner for Tom Skehan, former Town Manager of Athy, to mark his recent retirement from Kildare County Council, will be held on Friday the 18th of September in Killashee Hotel, and all are welcome.

The Cathaoirleach advised the members that a follow up meeting with Athy Traffic Committee will take place as soon as possible.

26. Manager’s Business.
The Town Manager requested that the election of the Budget Committee would be deferred till next month’s meeting. This had the unanimous agreement of the members.

The Town Manager advised the members that Helen Dowling, RAPID Co-ordinator would give an up-to-date briefing on the Interreg Project at next month’s meeting.

27. Report from Sub- Committees.
Arts Committee: The Cathaoirleach gave a positive progress report on the Methodist Hall, which was welcomed by the members, and thanked the Town Manager, on behalf of the members and herself, for ensuring that this project was finally realised

RAPID: Councillor Daly gave report to the members on RAPID. This was noted by the members.

Tidy Towns: Councillor Redmond reported to the members on the continuous hard work undertaken by its dedicated members in trying to keep Athy clean and litter free

Town Twinning: Councillor Redmond advised the members that the recent stay of French students, under the exchange programme, was a great success. This was noted by the members.

Councillor Mahon advised the members that a meeting of the Joint Policing Committee was scheduled for the 29/09/09

Councillor O’ Sullivan requested a letter be forwarded out to Aidan McHugh congratulating him and his canoe team for doing so well in the Liffey descent competition.

“That we as a Council enquire from the Department of Education & Science as to what provision they are making for the children of Ardrew and Dunbrinn housing estates, as the distance from the said housing estates is 3 miles to the schools on the Monasterevin road and would be an endurance test for adults and children to walk that distance from their estates to the schools.”

“That we as a Council enquire under the Freedom of Information Act from the Department of Education, as to the cost of the rented porta-cabins at Scoil Mhicil Naofa, Athy, as they appear to many people, including myself, to be a waste of money with no future and to obtain the name of the owner of these cabins.”

“That Athy Town Council calls on the HSE not to transfer the ambulance emergency service to ambulance headquarters in Dublin.”

April Monthly Meeting Minutes

Minutes of April Monthly Meeting held on the 22^nd of April, 2009.

On the proposal of Councillor English, Seconded by Councillor Cunnane

Matters Arising.

Councillor O’ Sullivan sought an update on the clean-up from Croom-a-Boo Bridge re. motion 14. The Town Engineer advised the members that this would be done as soon as possible.

Councillor O’ Sullivan sought an update on the “children at play signs” in the Dun Brinn estate. The Town Engineer advised that the Council will obtain the signs and arrange with the contractor to have them erected. This was welcomed by the members.

Councillor Daly requested that the hoarding around the new swimming pool would be removed and the area cleaned up before the Tri-Athy triathon begins next week. The Town Manager advised the members that the main work to complete the development would begin shortly, but that in the interim, it was hoped that some preliminary clean up work would be completed before the Tri-Athy event next week.

Councillor English sought an update on the bus shelter. The Town Clerk advised the members that Iarnrod Eireann had being written to on this issue but we are still waiting on a reply and he will follow up again on this matter.

Councillor Wright sought an update on next years St. Patrick’s Day parade. The Town Clerk advised the members that the Council would arrange and facilitate a meeting with all local organisations before next year’s parade. This was welcomed by the members.

Councillor English requested that motion 11 on the April minutes be amended to include “seconded by Councillor Daly” and not Councillor English as originally reported. This was duly noted.

Correspondence.

The Town Clerk read out the following correspondence:

· Letter from Pauline Crowley, Rehab Group, inviting nominations for the 2009 People of the Year Awards.

On proposal of Councillor Frank English, seconded by Councillor Dalton, it was agreed that Mr. Billy Brown should be nominated for this year’s award. The members noted Mr. Brown’s ongoing work with the local Aontas Ogra group and more recently with the Athy Action for Youth Sub Committee in developing the new Youth Café at Meeting Lane. This had support of the other members.

The schedule for forthcoming conferences had been circulated previously to members and was noted.

5. Cathaoirleach’s Business

The Cathaoirleach said even though his tenure as Cathaoirleach over the last 12 months was a time of economic downturn in the country, and here in Athy, it was still a great honour and privilege to represent Athy Town Council and people of Athy as Cathaoirleach over the last year. The Cathoirleach said he would like to thank the members for their support and wish them all the best and good luck in the forthcoming elections. The Cathaoirleach said he would also like to thank the staff of Athy Town Council for their assistance and courtesy during his time as Cathaoirleach and the press for their positive coverage over the last year.

6. Manager’s Business.

Annual Financial Statement for 2008

The Town Manager advised the members that the Annual Financial Statement was completed and ready within the statutory timescale. He outlined the main elements of the report. The members formally noted the Annual Financial Statement

The Town Manager also sought an approval by resolution of the schedule of additional expenditure as contained in Appendix 9 in accordance with the provisions of the Local Government Act 2001 for Athy Town Council Annual Financial Statement 2008

On the proposal of Councillor Cunnane and seconded by Councillor English and agreed by all the members, the schedule of additional expenditure as contained in Appendix 9 was approved by resolution.

Athy Historical Trail

The Town Clerk circulated an update report regarding the historical trail project, which is due for completion this summer. He noted that the new trails would further promote the existing heritage status of the town.

Casual vacancy in membership of Council

The Town Manager advised the members that under Section 19 of Local Government Act 2001 the Council were statutorily required to have the casual vacancy, arising from the resignation of Tony Egan from the Council, on the agenda.

On the proposal of Councillor Breslin and seconded by Councillor Daly, the members agreed to have this adjourned until the June Monthly Meeting.

7. Report from Sub- Committees.

Town Twinning Committee

The Town Clerk advised the members the town twinning delegation from Grandvilliers would arrive for the 5^th anniversary celebration on Friday, 29^th May. A schedule of cultural activities was being finalised and would be circulated to members.

Tidy Towns

Councillor O’ Sullivan said this Committee and volunteers continued to do great work in improving the town’s appearance. This was echoed by the Cathaoirleach, who agreed and asked that the town should work together to

present the town at its optimum, particularly over the coming weeks and months when a number of national events were planned to take place.

1798 Committee

The Cathaoirleach advised the members that the final design and costings for the 1798 monument have being finalised and a further meeting of the above Committee would take place in late June to discuss and establish when this monument would be erected. This was welcomed by the members.

8. Planning Register.

9. Other Business.

Councillor Wright said even though the present caretaker does great work in the upkeep and maintenance of graveyards in Athy, another staff member, or a new employee was necessary to assist him due to the work involved. The Town Clerk advised the members that the present financial position does not permit the Council to employee a new staff member.

Councillor Wright said a box sewer appeared to be blocked on Leinster Street and is causing a considerable smell for residents and shop owners on that street. The Town Engineer noted that surveys has been completed and remedial works were being proposed.

Councillor Wright said the approach area to the Council yard should be better presented and required road works to improve the area. Councillor Wright requested that this area be cleaned up by the Council as soon as possible. The Town Engineer advised the members that monies have been allocated under the annual road block grant and that he was hoping to have works carried out later in the year. This was welcomed by the members.

The Cathaoirleach noted that this was the last monthly meeting that Councillor English and Councillor Cunnane will be attending, as they are retiring on the election of the new Council, and now would be an appropriate and opportune time for his colleagues to say a few words on this auspicious occasion.

The Cathaoirleach said that Councillor English, who was first elected to this Council in 1967, and has given over 42 years of unbroken service, as a member of Athy Town Council, and to the community of Athy, was during that time totally committed and dedicated to this Council and for the good of Athy. The Cathaoirleach said Councillor English, over the years, had become a close friend and colleague to all past and present members, including himself and will be sadly missed. The Cathaoirleach said that personally, he would like to wish Councillor English and his family all the best on his retirement and for the future.

Councillor Dalton said he hoped to convince Councillor English not to retire but, sadly, did not succeed. Councillor Dalton said Councillor English made a considerably contribution to this Council over the many years he was a member and was always held in high esteem by his colleagues and respected by people of Athy, for his steadfast commitment and never ending work on their behalf over the years. Councillor Dalton said he would like to wish Councillor English and his family all the best for the future on this retirement.

Councillor Daly said that it was an honour to work along side Councillor English during his time as member of Athy Town Council Council and would now like to wish him and his family all the best on his retirement.

Councillor Breslin said the trojan work Councillor English did over the years for this Council and the people of Athy was outstanding and a great achievement Councillor Breslin said his advice and guidance was greatly valued and appreciated by his colleagues and that he should be proud of his 42 years of service as a member of this Council, and would like to wish him and his family all the best for the future.

Councillor Cunnane said it was a magnificent accomplishment to have such a long and distinguished service as a member of Athy Town Council. Councillor Cunnane said during their times as councillor there was never a cross word exchanged between them. Councillor Cunnane said Councillor English was a good colleague and would like to wish him and his family every happiness on his retirement.

Councillor O’ Sullivan said Councillor English had a great belief and faith in what ever he did as a member of this Athy Town Council. Councillor O’ Sullivan said that Councillor English was greatly respected by his colleagues and trusted by the people of Athy to work on their behalf. Councillor O’ Sullivan said, like her previous colleagues, she would like to wish Councillor English and his family a long and peaceful retirement.

Councillor Wright said Councillor English was a diligent and a hard working member of this Athy Town Council, who did his best at all times for the people of Athy. Councillor Wright said he would like to wish Councillor English and his family all the best for the future.

The Town Manager said Councillor English was a member who had great experience and confidence and was not afraid to make important and hard decisions when required. The Town Manager wished him and his family all the best for the future.

The Town Clerk said on behalf of the staff and himself he would like to thank Councillor English for his courtesy and professionalism with the staff over the years and would also like to wish him and his family a happy retirement.

Councillor English said he would like to thank the people of Athy who elected him to Athy Town Council on seven occasions. Councillor English said it was a great honour to have served the people of Athy for the last 42 years and that everything he did as a member of Athy Town Council was for them. Councillor English said over the years, he was privileged to work along side excellent councillors, and would like to thank past and present colleagues for their support and friendship and will miss working along side them on the Council. Councillor English said on behalf of his family and himself, he would like to thank his colleagues and staff of Athy Town Council, for their kind and thoughtful words and wished his colleagues all the best in the forthcoming elections.

The Cathaoirleach said that Councillor Cunnane was first elected to this Council in 1994 and in all that time, his service to Athy Town Council and to the people of Athy, was 100 hundred per cent. The Cathaoirleach said Councillor Cunnane was a gentleman to work with, and his colleagues greatly appreciated his support, advice and friendship over the years. The Cathaoirleach said that Councillor Cunnane will be missed by all and would like to wish him and his good family the very best on his retirement.

Councillor English said that Councillor Cunnane during his time as member of this Council, acted at all times, with great integrity and absolute honesty. Councillor English said Councillor Cunnane was man of principle, who was admired and held in high regard by his colleagues and the community of Athy. Councillor English said he would like to wish Councillor Cunnane and his family a long and happy retirement.

Councillor O’ Sullivan said that Councillor Cunnane was a conscientious and respected member of this Council and that personally, would like to thank him for his friendship and advice over the years and will always be eternally grateful for this. Councillor O’ Sullivan said she would like to wish Councillor Cunnane and his family all the best on his retirement and that he will sadly be missed by his colleagues and staff.

Councillor Daly said that he would like to thank Councillor Cunnane for his help and encouragement over the last five years. Councillor Daly said members of Athy Town Council would not be here today without the support and loyalty of their families, and was sure this was the same for Councillor Cunnane and would like to wish him and his family, a very long and happy retirement.

Councillor Breslin said there is great sadness here today with the retirement of Councillor Cunnane. Councillor Breslin said his colleagues had the highest respect for him, both personally and politically, and that he made a positive contribution to this Council and to community of Athy. Councillor Breslin said that Councillor Cunnane should enjoy his retirement and would like to wish him and his family all the best for the future.

Councillor Dalton said that Councillor Cunnane was someone who had a great love and interest in politics, which was evident during his time as member of this Council. Councillor Dalton said that Councillor Cunnane worked with his colleagues tirelessly for the people of Athy and was someone you could trust to do the right thing and stand by his principles, and would like to take this opportunity to wish Councillor Cunnane and his good family all the best on his retirement.

Councillor Wright said even though, they would have differed on issues over the years it was never personal, and that all times, found Councillor Cunnane to be a decent and honourable person and wished him and his family all the best on his retirement.

The Town Manager said Councillor Cunnane was a member of Athy Town Council whose input and opinions were greatly valued and respected by his colleagues and people of Athy and who was never afraid to make important and hard decisions when required. The Town Manager wished him and his family all the best for the future.

The Town Clerk said on behalf of the staff and himself he would like to thank Councillor Cunnane for his courtesy and with the staff over the years and would also like to wish him and his family a happy retirement. He further noted that he hoped that both Councillor Cunnane and English would continue to take an interest in the town’s development and progress.

Councillor Cunnane said he would like to thank the people of Athy who elected him on three separate occasions to this Council. Councillor Cunnane said their trust and faith in him was very humbling and appreciated. Councillor Cunnane said his time as a member of this Council was, on occasions, very challenging but also very rewarding and will miss working along side his colleagues for the good of Athy. Councillor Cunnane said like Councillor English, on behalf of his family and himself, would like to thank his colleagues and staff of Athy Town Council, for their kind and thoughtful words, and wished his colleagues all the best in the forthcoming elections.

The Cathaoirleach welcomed Helen Dowling, RAPID Co-ordinator, who was present to give an update to the members on RAPID projects in Athy.

Ms. Dowling’s report outlined details of projects already completed, projects presently ongoing in conjunction with the Council and local agencies, and projects proposed for the future. It was noted that funding for some future projects would be limited as a number of funding sources had being restricted.

The Cathaoirlerach, on behalf of members and himself, thanked Ms. Dowling for her thorough report and on the great work RAPID carries out in association with the Council, and other local agencies in the town, and hoped this may continue for the foreseeable future.

Adoption of Minutes

Minutes of Monthly Meeting held on the 18^th of March, 2009.

On the proposal of Councillor Cunnane, seconded by Councillor Dalton.

1. Matters Arising.

Councillor Daly referred to the old swimming pool site (page 1), and requested that the Council would consider submissions from the members, and the public, on how best to utilise the old swimming pool for the people of Athy. The Cathaoirleach said it was imperative that the views and opinions of the members are included in any final decision on the old swimming pool.

The Town Manager advised the members that their views and opinions would be included, in any final decision, on how best to utilise the old swimming pool. This was welcomed by the members.

Councillor O’ Sullivan sought an update on the “children at play” signs in the Dun Brinn estate (page 1). The Town Engineer advised he would liaise directly with the developer, as the estate is not yet taken in charge. He was hopeful that the signs would be erected, with the co-operation of the developer.

The Cathaoirleach said such signs should be part of developers’ conditions when they get planning permission to build new estates, and not the responsibility of the Council.

Councillor Wright sought an update on Iarnrod Eireann (re. parking charges at station). The Town Clerk advised the members that the Council had written to Iarnod Eireann on this matter, but are still waiting on a reply, and he would again follow-up this matter.

Council Cunnane requested and update on when the report on the operation of the Tuesday market would be completed and presented to the members. Councillor Cunnane said there is a serious safety issue at the market, and this needs to be urgently addressed. The Cathaoilreach said the Tuesday market does require proper and up-to date regulation. The Town Clerk advised the members that the Council have sought a report from the Council’s solicitor and that the matter had been referred to counsel for opinion.

Councillor Breslin referred to motion 8 and sought an update, on when the survey of housing stock, in Castlepark would be completed. The Town Clerk advised the members that it was hoped to have this completed as soon as possible, and will revert back to them when it is concluded. This was noted by the members.

2. Correspondence.

The Town Clerk read out the following correspondence:

· Letter from Kildare Youth Services Athy requesting the Council’s assistance in locating a more suitable premises for their work with the youth of Athy. The Town Clerk advised the members that he would meet with the representative of KYS in Athy on this matter. This was noted by the members.

· Letter from Liam Dunne, Chairman, Kildare County Show seeking financial assistance towards the running of this event. It was agreed that €500 contribution would allocated towards the event.

On the proposal of Councillor Dalton, seconded by Councillor English.

· Letter from Association of Municipal Authorities of Ireland outlining the format of the forthcoming Annual Conference in September. This was noted by the members.

· Letter from Monaghan Town requesting the Council’s support for a motion passed at their March Monthly meeting. This was noted by the members.

· Letter from Killarney Town Council requesting the Council’s support for a motion passed at their March Monthly Meeting. This was noted by the members.

The schedule for forthcoming conferences had been circulated previously to members and was noted.

3. Notices of Motion:

4. “That in light of the issues raised in the decision reached on Planning Ref 07/300060 that this Council now remove from the list of protected structures, The Abbey (House ref Ay 078)” – Cllrs. Dalton & English

“That Athy Town Council de-lists the building referred to as The Abbey as it is not of any historical significance and its current status has had negative impact on more than one planning proposal.” – Cllr. Daly

On the proposal of Councillors Dalton and Daly, seconded by Councillor English

Councillor Dalton said he was disappointed, that the report on the possible de-listing of the Abbey has still not being completed by the Conservation Officer of the Planning Department in Kildare County Council. Councillor Dalton said it is now urgent, and imperative, that this report be completed as soon as possible, and presented to the members for consideration, so some progress could be made on removing this building from the list of protected sites in the Town Development Plan, as it is holding up any further development in the area.

Councillor Daly said this building has no important historical significance and by removing it from the list of protected structures, it would send out a clear message of encouragement for people to invest in Athy.

The Cathaoirleach advised the members that a “special meeting” would be called, if necessary, before the coming elections so that the members could have a proper discussion and give adequate consideration to the report.

The Town Manager advised that he would liaise with the Planning Department and understood that a report from the owner of the site had been requested and was awaited.

Councillor Wright

6. “That in view of the enormous interest shown in the St. Patrick’s Day celebrations, I propose that we as a Council give a lead in the next St. Patrick’s Day parade, by writing to local organisations in the town and holding a meeting during the year so as to get it off the ground as we as a Council were shown in poor light at the last parade”.

On the proposal of Councillor Wright, seconded by Councillor O’ Sullivan

Councillor Wright said it was disgraceful and a shame, that this Council, along with the Chamber of Commerce and RAPID, had not come together to make a concerted effort to organise this year’s St. Patrick’s Day Parade in Athy. Councillor Wright said it was left to two local members of the community to ensure a parade took place, which was a great success, and a credit to everyone concerned. Councillor Wright said it is imperative, that this Council, take the lead and get in contact and liaise with all local groups in Athy during the year, so that a St. Patrick’s Day Parade for next year is properly organised in time.

Cllr. O’Sullivan agreed with the motion and congratulated those who had organised this year’s parade.

Cllr. Cunnane noted that organising the parade should be a cross-community project and that the Council could lead in bringing local groups together to organise a future parade.

This motion had the unanimous support of the other members present.

7. “That we as Council conduct a search of the lands from St. John’s Lane up to Greenhill’s as it is nothing short of the a wilderness and rats have been noticed crossing the pathway to the shock of the people using the path”.

Councillor Wright requested that this motion be deferred until the next monthly meeting.

8. “That this Council request Bus Eireann and private bus operators to consider providing bus shelters in the town”.

On proposal of Councillor Dalton, seconded by Councillor English

Councillor Dalton said it is a disgrace that in the 21^st century there is no bus shelter in Athy for the public to wait under during inclement weather. Councillor Dalton said the Council should request Bus Eireann or any other private bus operator to erect such a shelter as soon as possible.

Councillor O’Sullivan said that she had similar motion before the Council some time ago, but no further progress was ever made.

The Town Clerk advised the members that the Council would again write out to Bus Eireann on this matter, and will revert back to the members upon receipt of reply. This was noted by the members.

9. “That consideration be given to removing the boundary wall between Dooley Terrace and Carbery Park/ Townspark in order to deal with the ongoing problem of illegal dumping”.

On proposal of Councillor Dalton, seconded by Councillor English

Councillor Dalton said people are illegally dumping between the two estates. Councillor Dalton said this was unfair on the decent people, within the respective estates, who are genuinely trying to keep it clean and properly maintained. Councillor Dalton asked that the Council should look at the possibility of removing the boundary wall between the two estates, as one way of stopping this dumping.

The Cathaoirleach advised the members that a considerable amount of money was spent, some time ago, on cleaning up the back of estates. The Cathaoirleach said that if anyone is aware or has knowledge of who is doing the dumping they should report it to the Town Council or local Gardai, who could liaise with the Council.

This motion had the unanimous support of the other members present.

The Cathaoirleach requested that motion 10 and 11 be taken as a composite motion. The members agreed to this.

Councillor Dalton English

10. “That greater enforcement measures be undertaken to prevent dogs being walked in the town’s cemeteries.”

Councillor Daly

11. “That Athy Town Council address the stray dog and fouling issue on our streets”.

On proposal of Councillor Dalton, seconded by Councillor English

Councillor English said members of the public who walk their dogs through local cemeteries are totally lacking in consideration and sensitivity, for those people visiting the graves of their loved ones, and requested that the Council put in place some enforcement measure so this would stop.

Councillor Daly said there is a persistent problem of dog fouling around town, which is totally unhygienic, and has health implications for everyone. Councillor Daly said the onus should be on the owners to clean up after their dogs, and in the case of strays, they should be impounded. Councillor Daly said the Council should do whatever is legally required to address this unsightly and persistent problem

The Town Engineer advised the members that the Town Foreman is presently organising signage, prohibiting dog fouling, to be erected at the cemeteries and other possible areas in the town. This was welcomed by the members.

12. “That Athy Town Council condemn the unfair treatment of our citizens in the recent Budget, affecting all from the elderly to the public service”.

On proposal of Councillor Daly, seconded by Councillor O’ Sullivan

Councillor Daly said it is completely unfair, and punitive in the way our elderly, and other vulnerable sections of the population have being treated in the recent budget, while those who made the vast fortunes, and caused the present economic downturn have not being brought to account, and take greater responsibility for their actions, which regrettably, will not happen.

Councillor O’ Sullivan said she has first hand experience, through her work, on how this budget is causing a lot of hardship, and distress for our elderly.

Councillor Breslin said it is PAYE worker again who is paying for the present economic mess, and not those who made the large speculative profits.

Councillor Cunnane said the anger and rage of the population, especially among the vulnerable members of our society, at the present appalling economic mess, is quite understandable and warranted.

Councillor Dalton said while he is fully aware of the present economic situation, and appreciates and accepts, what his colleagues have said, we must also recognise, that this economic downturn is not just confined

to these shores and is worldwide, and regrettably, there is no easy way out of worldwide economic crisis.

The Cathaoirleach said certain wealthy individuals can live in this country avoided paying tax due to residency requirements under taxation laws, and this is completely unfair for the majority of the population, who have to pay theirs. The Cathaoirleach said he would support this motion, and requested a vote on it.

13. “That Athy Town Council arrange for the provision of a yellow box between end of Emily Row and Meeting Lane to facilitate traffic flow (in front of King’s shop).”

Proposed by Councillor Cunnane, seconded by Councillor English.

Councillor Cunnane said a motorist coming out of back lane cannot turn left or right as there is a bottleneck at this junction and requested that a yellow box be put in place to alleviate this problem.

The Town Engineer advised that members he would investigate the possibility of making improvements at this location. This was welcomed by the members.

Councillor O’Sullivan

“That Athy Town Council join in clean up from Crom-a-boo Bridge in preparation for Tri Athy”.

On the proposal of Councillor O’ Sullivan, seconded by Councillor Daly.

Councillor O’Sullivan requested that the Council would clean up the area at Crom-a-Boo Bridge before the forthcoming Tri-Athy triathon in the town.

This motion had the unanimous support of the other members present.

Councillor Breslin

15. “Can a definitive date be given for the provision of a wall and railings at the Swimming Pool and when the rubble will, debris and containers be removed from the site”.

On the proposal of Councillor Breslin, seconded by Councillor Daly

Councillor Breslin said even though the new swimming pool has being opened for eight weeks, there was still rubble, debris and containers on site. Councillor Breslin said this was unacceptable and unfair to the local residents. Councillor Breslin it is now imperative, that the site is cleaned up and the proper landscaping is put in place immediately for everyone concerned.

Councillor Daly said the site should have being cleaned up some weeks ago and, like his colleague, strongly demanded that the area in question be cleaned up now.

This motion had the unanimous support of the other members present.

The Town Manager advised the members that funding is available to complete the works at the new swimming pool, and he understood that works would be completed shortly. This was welcomed by the members.

16. “That Athy Town Council does not permit the establishing of Management Companies in housing developments”

Councillor Breslin requested that this motion be deferred until the May Monthly meeting. All the members agreed to this.

. 17. Cathaoirleach’s Business

The Cathaoirleach said on behalf of the members and himself, he would like to welcome Noel O’ Driscoll, who will now be reporting on the monthly meetings, on behalf of the Kildare Nationalist, as Chris Fingleton, who previously reported for the paper, has taken up a new position as sub-editor of the Carlow Nationalist. The Cathaoirleach said on behalf of everyone, he would like to wish Chris all the best in his new job. This had the support of all the members present.

The Cathaoirleach also informed the members, this was the last monthly meeting that Marie O’ Riordan (KFM Radio), would be reporting on, as she will be leaving her job to undertake other projects. The Cathaoirleach said he would like to take this opportunity, on behalf of the members and himself, to wish Maire all the best for the future. This had the support of all the members present.

The Cathaoirleach requested that members be elected to the 1798 Monument Committee.

18. Manager’s Business.

The Town Manager advised the members that formal approval was expected from the Department of Environment Heritage and Local Government for funding to upgrade the present waste water network in the town under the SLI programme. This was welcomed by the members

The Town Clerk advised the members that, Councillor Tony Egan, in accordance with Section 18(4) (a) of the Local Government Act 2001, is deemed to have resigned from membership of Athy Town Council, as a result of his absence from attendance at any meeting of Athy Town Council, for a continuous period of 6 consecutive months, and that he has being formally notified of this. This was noted by the members.

19. Report from Sub- Committees.

Arts Committee

The Town Manager advised the members that he remained amenable to sign the lease for the Methodist Church as soon it is presented to him. A number of preliminary matters are being finalised. This was welcomed by the members

Town Twinning Committee

The Town Clerk advised the members that the Council had applied for an EU grant to assist with events proposed during the visit of the visiting delegation from Grandvilliers over the June bank holiday weekend, but, regrettably, the application had been unsuccessful. This was noted by the members.

Tidy Town Committee

The Cathaoirleach reported that this committee are doing great work, however, additional volunteers were required and anyone interested in joining should contact the Council. This had the support of all the members present.

20. Planning Register.

Noted.

21. Other Business.

Councillor Breslin said there are certain areas in the town where people, specially the young, are drinking alcohol openly, and was resulting in anti-social behaviour. Councillor Breslin requested that Council officials review the existing alcohol bye-laws as one way of curtailing this drinking and anti-social behaviour in the town.

Councillor Breslin said the Angling Club have requested that additional “no dumping signs” be erected along the River Barrow, where angling takes place. The Town Engineer advised the members that he would liaise with the club on this issue.

Councillor Breslin requested a letter of congratulations be forwarded to Athy Order of Malta Cadets, who participated and did very will, in a recent competition in Dundalk.

Councillor Cunnane requested fluorescent markings be put down on certain streets around the town, as they are quite necessary on dark evenings. Councillor Cunnane said such markings would give extra visibility, and make it a lot safer, for pedestrian and motorists alike. The Town Engineer advised the members this would be considered.

Councillor Daly reported that some of the parking meters do not take 10cent coins. The Town Clerk advised the members that he would check to see if the machines could be modified.

Councillor Daly said he was saddened and disappointed that South Kildare was losing Sean Power as a Junior Minister. Councillor Dalton added it was very beneficial and helpful to have a Junior Minister representing South Kildare and, like his colleague, was also disappointed that Deputy Power was losing this position.

Councillor O’ Sullivan reported that some cars in Meeting Lane were broken into, and requested, that the Council look at the possibility of erecting CCTV in that area, as a way of stopping further break in of cars.

The Cathaoirleach welcomed Arthur Lynch and his colleagues who were in attendance to give a short presentation on the forthcoming annual ‘Tri-Athy’ triathlon in Athy.

A presentation was given to the members regarding the previous two triathlons and the proposed changes this year.

The members were unanimous in their praise and support for the work of the organisers in developing such an event in the town.

The Cathaoirleach thanked the group for their presentation, and on behalf of the members and himself, wished them even greater success this year and in the coming years.

2. Matters Arising

Councillor Breslin referred to previous media reports regarding palisade fencing at the new swimming pool and enquired why Kildare County Council’s Press Officer has still not apologised to the members. The Town Manager said he was disappointed this issue was raised again, as an apology was not necessary or required from the press officer.

Councillor Daly said he was happy that some progress has eventually being made on the issue of the palisade fencing.

Councillor Wright said a bridge was necessary across the river Barrow and wanted to know when the proposal would be advanced. The Town Manager replied that due to the present economic situation funding for the bridge would be difficult to source, and would more than likely have to be put on hold for the foreseeable future, until the overall economic situation improves.

Councillor Cunnane referred to page 6 (re. motion 13) and enquired whether any further progress has being made, with setting up a meeting with between Athy Town Council, Athy Chamber of Commerce, and other local groups, with the aim of jointly promoting the forthcoming National Ploughing Championships in Athy. The Cathaoirleach advised the members that Athy Chamber of Commerce would be meeting with the members “in committee” at the next monthly meeting.

3. Correspondence

The Town Clerk read out the following correspondence:

· Letter from St Michael Boxing Club seeking financial contribution for the forthcoming boxing tournament (and hosting the USA Elite Boxing Team) to be held on 1^st March next in Athy.

It was agreed that €500 contribution would allocated towards the event and that the Council would host a welcome reception for the visitors and local club.

On the proposal of Councillor Breslin, seconded by Councillor Daly.

· Letter from IPBMI informing the Council seeking Council nominee attend and vote at its general meetings.

It was agreed by the members that the Cathaoirleach would be Council’s nominee.

· Letter from Gwynne Thomas requesting that Abbey House, Back Square, Athy, Co. Kildare be removed from Athy Town Council’s record of protected structures. This was noted by the members.

· Letter from Mullingar Town Council requesting the Council’s support for a motion passed at their January Monthly meeting. This was noted by the members.

· Letter from Special Olympics Ireland requesting the Council’s support for their forthcoming “Granny of the year” competition. This was noted by the members.

5. “That an update be given on the proposed usage of the site of the former swimming pool.”

On the proposal of Councillor English, seconded by Councillor Dalton.

Councillor English said the former swimming pool gave great service to the people of Athy over the many years it was in use, and it was now imperative, that something positive be done with the old swimming pool building and site, so that it could be still of some benefit or use to the local community, otherwise the building would fall into disrepair, which would be a great shame. Councillor English also asked that the plaque, erected in the old pool, with the names of people, who were on the original committee set up to have the pool built, be transferred to the Heritage Centre for posterity.

Councillor Dalton asked that the members and the local community be kept up-to-date and briefed regularly by council’s officials on what they propose to do with the building and site in the future.

This had the support of the other members present.

The Town Manager advised the members he would examine the site with the Town Engineer and would revert back to the members with possible proposals on how best to utilise the site in due course.

6. “That an additional public light be provided at the entrance to Shanrath housing estate.”

On the proposal of Councillor Dalton, seconded by Councillor Breslin

Councillor Dalton said this motion was self-explanatory, but asked that public lighting be put in place as soon as possible.

This motion had the support of the other members.

7. “The national concern regarding lead pipes system servicing houses throughout the country has been noted. As a precautionary measure, I propose that we, as a Council, investigate and have water tests carried out at locations in Upper & Lower St. Joseph’s Terrace and at Offaly Street and other places in the town.’’

On the proposal of Councillor Wright, seconded by Councillor Daly

Councillor Wright said it would not take much to carry our scientific water test in the town and requested that this be carried out by the Council as soon as possible.

The Town Manager replied that the Environmental Health Officer (Health Service Executive) carries out periodic testing for incidence of lead and other possible pollutants in the drinking water in the town. All tests carried out to date have shown the quality of drinking water in Athy to be within the acceptable thresholds. This was welcomed by the members

8. “That we, as a Council, investigate if Iarnrod Eireann seek planning permission to have a pay parking business established on their property with a private company, as people who are clamped have to pay €125 to get their cars freed.”

On proposal of Councillor Wright, seconded by Councillor Dalton

Councillor said it is pointless in trying to encourage the local community to use public transport if they are going to be charged for parking and fined in some instances. Councillor Wright said this was unfair, as it increases the financial burden local commuters are incurring due to the present economic situation.

The Town Manager explained that planning permission was not required for the recent change at the car park.

Councillor Dalton requested the Council write to Iarnrod Eireann expressing the members’ disappointment that commuters are charged for parking at the station. This had the support of the other members.

9. “That we, as a Council, thank Athy Town Council staff for the great work carried out on their houses such as the windows, doors and gas installation. The people are very pleased with such works.”

On proposal Councillor Wright, seconded by Councillor O’ Sullivan

Councillor Wright said he would like to compliment and thank the staff of the Council for the work carried in the recent installation of windows, doors, central heating and insulation into Council houses. He wished to have it noted that the works were welcomed and appreciated by the tenants.

Councillor O’ Sullivan said the work carried out by staff was excellent.

Councillor Dalton said whilst the work completed was greatly welcomed, there is still some outstanding works to be finished, and requested that this be done as soon as possible.

The Town Clerk thanked the Councillor for his kind comments which would be conveyed to the staff members.

The Town Manager advised the members that a Capital Housing Work Programme for 2009 was presently being prepared and would be presented to the members when finalised.

Councillor Daly

10. “That Athy Town Council immediately commences the mid-term review of its Town Development Plan.”

On the proposal of Councillor Daly, seconded by Councillor Cunnane

Councillor Daly said with the economic downturn, now would be an appropriate time, to carry out a review of the Town Development Plan and asked this be carried out as soon as possible.

Councillor Cunnane said the review should highlight those sections of the Development Plan which have being realised, and those sections which have become unrealistic and not possible due to the overall economic downturn. This had the support of the other members

The Town Clerk advised the members a progress report on the Town Development Plan is presently being finalised and would be presented to the members when completed. Further reviews of the plan would be progressed as specified in the Planning & Development Acts.

11. “That Athy Town Council request Kildare County Council to included finance for the Southern Distributor Route in its capital projection.”

On the proposal of Councillor Daly, seconded by Councillor O’ Sullivan

Councillor Daly said even though the proposed Southern Distributor Route is becoming more urgent and necessary every day, the project has come to an impasse due to lack of finance. Councillor Daly said like everyone else, he is aware that the present economic situation makes it more difficult to source funding for this project, but would request that Kildare Council make a concerted effort to allocate some funding for this project in its Capital Roads Projections.

Councillor O’ Sullivan said the members were informed some time ago that funding was available for this project but it now appears this is not the case. Councillor O’ Sullivan requested that some funding be sourced to advance this necessary and vital road project.

Councillor Cunnane said it is imperative this project is given full consideration by Kildare County Council so that some progress can be made.

This motion had the support of the other members.

The Town Manager replied that Kildare County Council have carried out a lot of preliminary work, which is now completed. In addition, he noted that the agreement with Iarnrod Eireann on the layout of the route had also been achieved. However the Town Manager advised the members that further progress on the project will depend ultimately on funding and that the present economic downturn will make it more difficult to source.

12. “That Athy Town Council addresses the inadequate lighting and anti- social behaviour in Garter Lane area.”

On the proposal of Councillor Daly, seconded by Councillor O’ Sullivan.

Councillor Daly said people are congregating in the Garter Lane area, which was leading to a lot of anti-social behaviour. Councillor Daly said this was very intimidating for local people going about their business.

Councillor O’ Sullivan said she had similar motions before the Council on this issue.

Councillor Wright said he also had previous motions to have this area cleaned up.

The Town Clerk said this issue could be raised under the Joint Policing Committee.

The Town Engineer also advised the members he would examine the possibility, of using some monies, allocated under the Road Block Grant Scheme for 2009, to carry out some improvement works in this area.

13. Cathaoirleach’s Business

The Town Clerk advised the members that an overdraft of €1million for a further six months was required and approval was now sought from the members. The Town Clerk also advised that this approval would be subject to formal sanction by the Department of Environment, Heritage and Local Government.

On the proposal of Councillor Cunnane, seconded by Councillor Dalton, it was agreed to approve the overdraft for a further six months (subject to sanction by the DoEHLG).

15. Report from Sub- Committees

Arts Sub Committee

Councillor Breslin informed the members that the AGM of the Art’s Committee was scheduled to take place on the 25^th of February at 7.30pm. This was noted by the members.

Tidy Town’s Committee

The Cathaoirleach ask that the Committee liaise with Town Engineer and Town Clerk to organise a programme of works for the forthcoming season.

17. Other Business

Councillor O’ Sullivan requested that ‘children at play’ signs be erected in the Dun Brinn estate as a safety measure. The Town Engineer replied he would get in contact with the relevant developer to erect the signage as soon as possible. The Cathaoirleach said the onus should be on the developers, as part of their planning permission, to erect the necessary signs in any estate they have built and should not be responsibility of this Council.

Councillor Wright enquired if the trees in the Main Square could be removed. However the other members were not in favour of this idea. The Town Engineer noted that he is currently looking at options that can be considered at this location.

Councillor Wright said there was some graffiti on the wall beside Bachelors factory and in other areas around the town and requested the Gardai investigate this. The Cathaoirleach noted that this could be raised at the next Joint Policing Committee.

Councillor Dalton reported illegal dumping in Dun Brinn estate and wish to have the matter investigated.

Councillor Daly informed the members that on Saturday, 14^th of February last, Mr. Rami Doraiswamy made a presentation of two rare books on Ernest Shackelton to the people of Athy. Councillor Daly said this was a great gesture and a unique occasion for everyone, which should be acknowledged by the Council. This had the unanimous support of the other members present.

Councillor Dalton said public lighting was reported out of order in many areas and estates in the town some time ago and appeared to have not yet been repaired. Councillor Dalton said this was completely unacceptable and asked the lights be repaired immediately. The Town Engineer said he would get in contact with the ESB to establish when the lights would be repaired.

Councillor Cunnane requested a report be given to the members regarding proposals on what the Council plan to put in place to solve the ongoing problem of illegal parking associated with the Tuesday market at the Back Square.

2. Matters Arising

Statutory Budget Meeting

Councillor Breslin referred to page four and explained it was Councillor Dalton who was elected to the Differential Rents Scheme (Housing) Committee and not Councillor Daly as recorded in the minutes. This was noted by the members and amended accordingly.

Swimming Pool Liaison Committee

Councillor Daly said the members were very unhappy with the reply received from Kildare County Council to their request to have a meeting before Christmas. Councillor Daly said he hoped that future requests for meetings and queries would be given full consideration by Kildare County Council.

Councillor Breslin referred to recent media comments made by Kildare County Council in connection with the removal of the palisade fencing surrounding the new pool. The Councillor stated that it appeared to be disrespectful of the democratic wishes of the members.

The Cathaoirleach said such comments were very unhelpful and sent out a message that this Council does not listen to public concerns and that this was wrong.

The Town Manager replied that Kildare County Council’s Press Officer had the utmost respect for the members and community at all times. The Town Manager advised that the concerns of the members and residents have being noted and would be incorporated into the draft proposals for the fencing, which were being prepared by Kildare County Council.

The Town Manager noted that the next meeting of the Committee had been scheduled for Wednesday, 28^th January next.

R417 Ardreigh Road Realignment

The Cathaoirleach welcomed George Willoughby, Senior Executive Engineer from the Road Construction Department in Kildare County Council. Mr Willoughby gave an update on the Ardreigh Road Realignment to the members and this was noted by the members.

The main drainage outfall works to the Barrow have been completed.
Road project to be constructed in two contracts.
The new road realignment will be approximately 750m in length.
Contract No.1 started on Monday 12^th January 2009 and should be substantially completed by mid April 2009 with Clonmel Enterprises Ltd as main contractor.
The scope of works on Contract No.1 consists of site clearance, earthworks, drainage, and ducting.
Contract No.2 will consist of kerbing, footpaths (at Athy end), public lighting (at Athy end), blacktop, the balance of drainage and ducting, landscaping and tie ins from the new to the existing roads at either end of the project with traffic management in operation.
Procurement for Contract No.2 still has to be carried out and it is estimated that civil works should be starting in May 2009 with substantial completion before the end of 2009.
Funding from the Department for the future works still has to be confirmed but the feedback to date from the Department has been positive. (SG funding of €2,113,000 has now been approved by the Department for the year 2009).
The Road Construction section of the Kildare County Council Transportation Department are supervising the civil works on both Contract No. 1 and 2.
The existing services are being left in position on the old road and allowance will be made for future access to them.
The completed project will aim to discourage illegal parking.
The on site archaeology dig is now completed.
The archaeological post excavation works are being carried out by a team of Archaeologists led by Ms Hilary Opie and employed by Kildare County Council.
A substantial amount of human remains, finds and artefacts have been uncovered.
The archaeological post excavation works should be substantially completed by the end of 2009 with the final report being issued by mid 2010.
Since their excavation the human remains have been sent to an osteologist (human bone specialist) for analysis which should be substantially completed by the end of 2009.
Re-interment of human remains is ultimately up to the discretion of the National Museum of Ireland, who treat each burial site on a case by case basis and on the results of the osteologist’s findings.
It was confirmed that a new path will be constructed under this project on the left hand side travelling from the Athy direction.
This new path will join up with a path now constructed by Athy Town Council and with a path to be constructed by the Kildare County Council Area Engineer on the left hand side from the Coneyboro Estate.
Pedestrians walking from the Athy direction can use this path on the left hand side and cross over to the right hand side using a new uncontrolled crossing.
Mr Willoughby assured members that pedestrian safety will be improved with the completion of this project.

Councillor Cunnane said he had previous motions before the Council asking for the footpath to be extended down to the Mill Lane and was disappointed this was not included in the plans. Councillor Cunnane enquired if the Road Construction Department were in communication with the Area Engineer on the issue of the footpath. Mr Willoughby confirmed that his Department were in contact with Area Engineer on this issue.

Councillor Cunnane expressed his frustration that the project was further delayed and the archaeology dig, which has been going on for four to five years, was quite costly.

The Senior Executive Engineer replied that expenditure to date on the archaeology dig was in the region of €3 million.

The Cathaoirleach enquired if some monies had being allocated to begin works. Mr Willoughby replied there was strong indication that funding would be approved by the Department of Environment, Heritage & Local Government.

The Town Manager noted that the Road Construction Department had put in an enormous amount of time and effort to the project and were anxious to get this job finished as soon as possible.

The Cathaoirleach thanked Mr. Willoughby for his update report on the Ardreigh Road Realignment.

3. Correspondence & Conferences

The Town Clerk read out the following correspondence:

· Report from Athy Town Council’s Arts Sub-Committee. This was noted by the members

· Letter from the Mayor of Grandvillier extending their good wishes and greetings to the Council for 2009 and advised that their Town Twinning Committee were looking forward to visiting Athy for the annual twinning in May. This was noted by the members.

Conferences

Scheduled of forthcoming Conferences and Seminars were already distributed to the members.

Councillor Dalton noted the AMAI Spring Conference was scheduled to take place on the 13^th & 14^th of February.

The Cathaoirleach asked that motions 8 (Cllr Breslin) &12 (Cllr Daly) be taken as a composite motion. All the members agreed.

8. “That Athy Town Council condemns the actions of Kildare County Council in introducing a €3 charge for the use of the Civic Amenity Centre and the reduction of the opening hours of the centre. Furthermore Athy Town Council calls on Kildare County Council to reverse both these decisions.”

12. “That Athy Town Council calls for the reversal of the recently introduced charge for the recyclable material at Athy Civic Amenity Centre.”

On the proposal of Councillor Daly, seconded by Councillor Breslin.

Councillor Breslin said litter and illegal dumping is a serous problem in the town and both will escalate further with the introduction of a fee for recycling and with the shortening of opening hours in the Civic Amenity Site as it will not encourage the public to recycle or discourage them from dumping. Councillor Breslin said what is now required is a concerted Public Relations campaign by the Council to promote and encourage recycling at the Civic Amenity Site through the distribution of information leaflets and educational visits by our Community Wardens to the local schools.

Councillor Daly said that one can visit Portlaoise Civic Amenity Site where there is no fee to recycle but in Athy we charge the general public and this is totally counterproductive and does not make sense, as it will not encourage the public to recycle.

Councillor Dalton said the charge was part of a cost saving package introduced by Kildare County Council in their Budget for 2009. Councillor Dalton said he requested the County Manager to maintain the services in the Civic Amenity Site in Athy at the same level as previous years.

Councillor Cunnane said the Civic Amenity Site was being under utilised. and this was a shame.

Councillor O’ Sullivan said she was prepared to pay the €3 charge for recycling.

The Cathaoirleach said electrical goods are free to recycle and there is no excuse for anyone to illegally dump, and if any one is caught doing it they should be fined and the case pursued in the courts where necessary.

The Town Manager replied Kildare County Council were not alone in introducing charges for recycling as majority of Councils have done like wise. The Town Manager said he would consider the possibility of distributing information leaflets as one way of promoting the Civic Amenity Site.

9. “That a full progress report be given in relation to the Southern Distributor Road and the Northern Distributor Corridor.”

On the proposal of Councillor Breslin, seconded by Councillor Dalton

Councillor Breslin said the members have not received recently a most up-to-date progress report on the SDR and NDR Routes. Councillor Breslin requested that a report be prepared and presented to the members as soon as possible. Councillor Breslin said she also understood that Kildare County Council were to come back to the members with a clear defined line on a map showing the outline of the NDR route. Councillor Breslin said this has not happened and was unacceptable.

Councillor Dalton said lot of work on the preliminary design of the NDR has already taken place and could not understand why no further progress has being made on this particular project. Councillor Dalton requested that any issues still outstanding on the NDR route be resolved quickly so that work can begin.

Councillor Daly said a public meeting about the overall traffic situation in Athy and the surrounding area and the proposed NDR route was organised by the IFA and held in the Clanard Hotel last week. Councillor Daly said it should have being the Council taking the lead on this issue and not another body.

Councillor Cunnane said he attended the meeting but was not in a position to answers any queries, if put to him, on the proposed NDR route as he did not have the most up-to-date relevant information. Councillor Cunnane said it is imperative and only correct that the members are regularly briefed and kept up-to date on the proposed routes.

The Town Manager said the members would in the future be given regular progress reports on the NDR and SDR routes and noted that the capital cost of the proposed schemes would be particularly high and that funding would be an issue.

10. “That in the future the agenda for the Council meetings includes the issuing of housing update report.”

Councillor Breslin said she only became aware this week the Council had purchased a house and allocated it to a tenant. Councillor Breslin said the members were never informed of this and should have come before the members to be discussed. Councillor Breslin requested that regular housing update reports be presented to the members at future Council Monthly meetings.

The Cathaoirleach said it was always policy, in the case of housing schemes, that a meeting would have been arranged with the members and the HSE, where a full report offers for the scheme would be presented to the members.

The Town Manager advised the members that when housing schemes are being allocated, a meeting would be arranged. The Town Manager requested the housing report be issued every two months. The members agreed to this.

Councillor Daly

11. “That Athy Town Council expresses its opposition to the education cutbacks in our schools which will have a negative impact on our children’s education.”

On the proposal of Councillor Daly, seconded by Councillor Cunnane

Councillor Daly said the proposed cut backs in education spending will result in increases in class sizes and teachers who are absent not replaced and this would have a detrimental effect on our children education. Councillor Daly said it was also unfair that our children and the public service will pay the price for mismanagement of the economy.

Councillor Cunnane said the proposed cut backs in education will have long-term affects and the government must recognise that investment in education is a priority and seek to maintain services.

This motion had the support of the other members.

13. That Athy Town Council, in conjunction with the Chamber of Commerce and other interested groups, establish a committee to exploit the potential offered by this year’s Ploughing Championship.”

On the proposal of Councillor Daly, seconded by Councillor Breslin.

Councillor Daly said the forthcoming Ploughing Championship in Athy is an opportune time for the Council and other local bodies to show case and promote Athy, as people will be coming here from all over Ireland and abroad.

Councillor Cunnane said presently Athy Chamber of Commerce meet with the Council every four months and requested that these meetings be held more often so that we can jointly promote Athy for the forthcoming Ploughing Championship.

The Cathaoirleach agreed and noted that this matter would be prioritised for discussion at the next meeting with the Chamber.

17. “That Athy Town Council re-examine internal traffic relief measures.”

On the proposal of Councillor O’ Sullivan, seconded by Councillor Daly.

Councillor O’ Sullivan said changes made to the flow of traffic at Meeting Lane and Chapel Lane are a great success and is greatly welcomed. Councillor O’ Sullivan asked the Town Engineer to look at the possibility of implementing more traffic changes around the town.

Councillor Daly requested the Council to implement these changes as soon as possible.

Councillor Cunnane said the pedestrian crossing at the post office is causing considerable delay in the flow of traffic and that the pedestrian crossing planned for Nelson Street has never being put in place.

The Cathaoirleach said this motion would be referred to the next Joint Policing Committee meeting.

18. Cathaoirleach’s Business

· Kildare County Council’s future plans with the old swimming pool.

The Cathaoirleach requested that a meeting be arranged to discuss proposals for the existing swimming pool site.

· Differential Rent Scheme (Housing) review

The Town Clerk said a meeting to review the present Differential Rent Scheme (Housing) was scheduled for Thursday 29^th of January. This was noted by the members

He further noted that a ten minutes grace period was not in the current Parking Bye Laws. This was noted by the members.

Councillor Daly advised that RAPID AIT had met before Christmas and were progressing a number of projects. The members noted this.

The Cathaoirleach said on behalf of Athy Town Council he would like to offer condolences and deepest sympathy to the family of Gillian Dempsey who passed away recently. There was a minute’s silence.

The Cathaoirleach said the Standing Order & Protocol Committee has being set up to look at the possibility of moving Monthly Meetings to 6.30pm and a meeting of this Committee should take place soon.

Minutes of Material Contravention Meeting held on 3^rd of December 2008

On the proposal of Councillor Daly and seconded by Councillor Cunnane.

2. MATTERS ARISING

Swimming Pool Liaison Committee

Councillor Daly said it is disgrace and a total insult to the members and the residents that a follow up meeting of the above committee had not been scheduled to date.

Councillor Breslin said that even though the members voted for the palisade fencing to be removed Kildare County Council still refuse to accept the democratic wishes of the members and residents and replace it with a more acceptable alternative. Councillor Breslin said that Kildare County Council should realise that the members are steadfast on this issue and are not going to back down.

Councillor Cunnane said that he supported his two colleagues on the issue of the palisade fencing.

Councillor Mary O’ Sullivan said that she hoped that the issue of the palisade fencing would be resolved to everyones satisfaction.

The Cathaoirleach said that he was also disappointed that the meeting did not take place.

The Town Manager said that all messages, communications and requests from the Swimming Pool Liaison Committee, regarding the issue, had been relayed by him, to the relevant departments and staff in Kildare County Council at all times.

Councillor Breslin formally proposed that a meeting of this committee take place before the Council closes for Christmas. This was seconded by Councillor Daly and had the support of all the other members.

Jetty- Barrow Quay

Councillor Daly sought an update on the jetty. The Cathaoirleach said that this would be formally considered at the Statutory Budget Meeting.

St Vincent’s Hospital

Councillor Wright requested another update on St Vincent’s Hospital. The Town Clerk noted that a reply had been received which stated that any future works on the structure would depend on available resources. Councillor Wright requests a copy of the correspondence. The Town Clerk advised that the correspondence would be referred to the Planning Department and that the building was listed as a protected structure in the Town Development Plan.

Trees at Heritage Centre

Councillor Wright said that he will refer back to this issue at January meeting.

The Cathaoirleach asked that the following be put on the Agenda for the January Monthly Meeting:

· Kildare County Council’s future plans for the old swimming pool.

· Review of the Differential Rent Scheme

Councillor Breslin said some horses were roaming freely and loose in Branswood Estate and enquired what steps the Council could take to have them removed.

The Cathaoirleach said that there is a pound based in Urlingford, which takes horses and is used by Kildare County Council and could be used by this council.

Councillor Wright asked that the seats in the Main Square be replaced with new one in the New Year.

Councillor Wright said that he was annoyed that the 1798 Monument was never erected and hoped that it would eventually be erected in 2009. The Town Clerk advised the member that he had been in discussion with the County Arts Officer and that finding monies an issue.

Councillor Cunnane asked that a progress report be given on the Ardreigh Road realignment project (Kildare Co. Council) at the next Council meeting. Councillor O’ Sullivan said that the new path did not appear to be able to accommodate all users.

The Cathaoirleach said that it is almost nearly a year since Councillor Noel Scully passed away. The Cathaoirleach said that he was still greatly missed by his colleagues and the people of Athy.

The Cathaoirleach informed the members that this was Tommy Skehan’s last meeting as Town Manager. The Cathaoirleach said that Tommy always gave one hundred percent to the town and to the council and was sure he would continue to support this council through his Directorate responsibility in Kildare County Council.

Councillor Cunnane said that Tommy did everything in his power for Athy and made a significant contribution to the overall development of this town.

Councillor Breslin said she knew Tommy before he came to Athy, and he was always someone you could approach and was always available to listen to your concerns and issues. Councillor Breslin said he was a fantastic people’s person and that his commitment, as Town Manager, was 24/7.

Councillor Daly said that he would like to compliment Tommy in the manner he carried out his duties as Town Manager. Councillor Daly said Tommy was always professional and courteous in his dealings and interaction with the members and that he always guided them in the right direction.

The Town Clerk said that he would like to thank Tommy for his advice and leadership and noted that Tommy was always generous with his time with staff members during his time as Town Manager. The Town Clerk said that on behalf of the staff and himself he would like to take this opportunity to wish Tommy all the best in his continued career with Kildare County Council.

Tommy Skehan said that his tenure as Town Manager was very challenging but also very rewarding and noted that during his time in the town, a number of significant developments projects had been progressed and in the future further projects would be realised. Tommy said he would always have always fond and positive memories of his time as Town Manager specially the kindness shown to him by this authority when he was ill. Tommy thanked everyone for their kind words and was sure the new Town Manager would give one hundred percent commitment to the members, staff and the people of Athy.

5. “That in view of the fact that the Ombudsman has ruled that all town councils are to provide waivers forms to people on social welfare benefits (and who are now denied them when this council privatised its waste collection) which means the financial burden on our people is disgraceful. People before dogs and race horses in government grants.”

6. “That in view of the continuous increases on social welfare recipients in our local authority houses, I propose that we have a complete review of our housing stock as the present system is a waste of money as on our tenants who will never own their houses but are being crucified by these rent increases.”

7. “That in view of the fact that the proposed footbridge across the River Barrow is in our Development Plan I propose that this council keep us up-to-date on this necessary project which should have been a prerequisite to our magnificent swimming pool’’
